Flaherty 75-282 Malulani Drive Kailua-Kona, ffi 96740 (808) 331-8146 November 9, 2006 Hawaii County Council Stacy Higa, Council Chairman and Hawaii County Council Members 25 Aupuni St., Suite 209 Hilo HI 96720 RE: Bill 251 Aloha, I am here to oppose Bill 251 because I believe that it is not good for the Kailua community at this time. Stanford Carr's development is creating no new infrastructure; it is just adding additional traffic problems. The community of Kailua Kona wants new developments to provide new roadways, not to simply funnel all its vehicular traffic onto the over-crowed existing roadways. We request that Mr. Carr be required to provide connectivity and to show contractual proof that he has right-of-way easements from his KCE development to Palani Road and/or to the Mamalahoa Hwy. so that the additional traffic is not solely directed onto the Queen Kaahumanu Hwy. Once again I stand in front of you as a Malulani Garden resident to respectfully request the relocation of access Road H to Brian Cooks lots just mauka of MG. If this isn't allowed to happen it will destroy the community cohesiveness, and substantially lower property values. If the KCE Road H access Plan is implemented it may financially ruin many of the home owners, some of whom have recently already placed there homes on the market after Mr. Carr's plans came to light. Some of the homeowners in MG have tried to hire a structural engineer to make an authoritative investigation of what we believe demonstrates the unsafe location of access "Road H", as well as a getting a comparative analysis of the adjacent mauka road site on property owned by Brian Cook. We were unsuccessful because of their unavailability with earthquake related commitments. Comm. No. ~'7-~Vo. Ref. Tcfl ease' Ref. 1DW&:_NOV 0 9 2008 -2- It is my understanding that county planner is not in favor of this mauka road idea, because the "mid-level road" was a condition of the PUD that allowed MG to be developed. There are, in fact, exceptions to changing the access roads that were required by a PUD, one being the Alii Heights Development, which required an access road onto Kuakini Hwy a site which was found to be unsafe. Because of the safety issues the road could not be dedicated. The decision was apparently made that this PUD road access was never to be enforced. We would also like to have the County Council make a re judgment regarding our "connectivity" road. So it comes down to pleading to the counsel members to deny the zoning application for this property until Mr. Carr can show the council members and the planning department that he has secured, in contract, the right-of-ways for the water and the roadway rights. That he has meet with the majority of developments neighbors to have a constructive dialog to hear there concerns and tell these concerned neighbors what he can provide to minimize the impact of his development. If requested The MG Home Owners Association will provide a updated mailing list for it residents.'
