Opposition to Bill 251
As homeowners in Malulani Gardens whose residence backs up to the proposed access
road, we are opposed to the use of this access route to the proposed Coffee Estates
development for the following reasons:
Safety: Our backyard wall is at the same level as the road and was built without
rebar support. Heavy trucks traveling on proposed access road on a
regular basis could easily damage our wall. The law requires a 15-foot
setback that the proposed access road is too narrow to accommodate. In
addition, there is no barrier protecting our backyard from a vehicle
possibly careening off into our yard and home.
Security: Even though there will be a proposed gate at both sides of the cross street,
there is nothing to stop someone from parking on the proposed access
road, jumping into our backyard and breaking into our home.
Sound: There are no proposed sound barriers for the proposed access road, so the
sounds of work trucks and equipment will be a constant disruption to our
lifestyle and render a high percentage of our total square footage unusable.
Alternative: We believe there is a reasonable alternative for the developer. A road
could be built on the south and mauka side of Malulani Gardens that
would be wider, safer and more acceptable to the homeowners of Malulani
Gardens.
