Testimony - to Hi County Council - August 23, , 2006 - Bill 309 - DELETE F-2 I am speaking as
Spokesperson for KBWAC -[Kealakekua Bay Watershed Advisory Council]- 323-3202
1. AGRICULTURAL CHARACTER OF THE NEIGHBORHOOD =_EXTENSIVE _AGRICULTURAL
DESIGNATION
a. Look at where this 100 acres is? Poised next to the Conservation Land(east)-- North, South, West
zoned 2 to 5 acres Agricultural lots. The Ahupuaha of Kealakekua Mauka-Makai is Ag. Historically, this
is an area of the Kona Field System. The farms below Napoopoo have Lychee orchards, citrus, and
coffee fields, lush and beautiful. With water and composting this pasture land can flourish.
b. LUPAG - it is a broad paint brush for the use of the land. The LUPAG land north and south is
"Important Agricultural". Keep it AG. You can change the LUPAG to "Extensive Agricultural" to meet
the State Requirement and meet the desires of the community. One member of your Planning
Commission said "Really, the State Land Use ought to be Conservation." Conservation or agriculture
would be fitting for the character of the community. Overwhelmingly the Community has said KEEP
SOUTH KONA AGRICULTURAL.
d. The SMA - Special Management Area Use Permit approved 2 acre ag OR LARGER. And the original
land division was approved with nine 3 acre lots to abut the Conservation Land above the Pali. Let's not
dilute that. We do not want "Rural" mixed use of "commercial, public, and community facilities." Two
acre farm lots is it, keep that,
II. DENSITY and USE- "Do not open Pandora's Box" :
a. Below this 100 acres is Conservation Land and below that the State Marine Life Sanctuary.
b. We must tread very lightly on the Aina. We do not want another Hilo Bay where pollution has
occurred from upland development,
c. More people, more poop.
d. Changing from Ag to Rural Designation(by the County's Definition) could lead to rezoning to 9,000
square foot lots and in the small print of PUD's subdivision code to 75 feet, a 6 story building!
e. Rural Designation allows mixed usage. We do not want "Rural" mixed use of "commercial, public,
and community facilities." That's for downtown Capt. Cook. Two acre farm lots is what it is, KEEP
THAT! Otherwise you are allowing a mixed use Suburban Subdivision.

III. WATER- higher flowing mauka to makai to ocean
1. Water Model - KSWCD - down and out to the ocean.
2. Flash Flood-Prone Area with multiple "Historical Drainage Trenches" and Napoopoo Road becomes a
flood way in a heavy rain.
There are 4 historical drainage trenches from north of Manago to Kamekani Road in Cook's Landing
Subdivision which send water flowing toward and through this 100 acres.
3. Flashflooding as Documented by Jiro_ Sumada, Deputy Director in the Dept. of Public Works. In
August of 2004 there was a period where 6.9 inches fell in 6 hours which is the equivalent of a 25 year
storm and in August of 2005 there was 3.12 inches in two hours which is the equivalent of a 50 year

storm.
4. County responsible as a Public Trust to protect the State's Water Resources. That means State of the
Art Septic and Monitoring.
IV. _DECLARATION OF RESTRICTIVE COVENANT 1. We understand the owner has volunteered a
"Declaration of Restrictive Covenant" restricting the property to RA-2a with a Rural Designation. We
applaud the introduction of the restrictive covenant, as this will hold the present density. We appreciate
the work that Representative Isbell has done in attempting to find a way to limit the density. We will
have our lawyers look at it this week. Kindly give the community time to respond. Obviously the
Covenant would need to be filed before the final reading and vote on Bill 309, so be open to this taking
longer than two weeks.
2. However, In order to protect the Character of this Agricultural Area and in order to protect Marine
Life Sanctuary, as spokesperson for the Kealakekua Bay Watershed Advisory Council, we want:
1. DELETE F-2,
and begin the Amendment Process again with Planning
2. EXTENSIVE AGRICULTURE Count LUPAG designation
3. RESTRICTIVE COVENANT
a. 2 acre lots forever
b. height restrictions to the standard 35'
c. Residential Agricultural Use,[ not mixed use with commercial, public, community facilities]
d. State of the Art Septic system
e. Monitor Subdivision with Groundwater Quality Testing Well System
