Overview of Civil Defense -
Responsibilities
The County of Hawai'i Emergency Operations Plan (EOP) is the document
that guides the County of Hawai'i in planning for, preparing for, and
responding to disasters. The following information is from the EOP.
County responsibility in event of disaster: The basic responsibility for
emergency planning, preparedness, response and recovery is vested in the
County government. This means the County is responsible for warning,
evacuation, police, fire, rescue and ambulance services, mass care,
damage assessment, debris clearance, health, medical and sanitation
services, public works, radiological protection, and any other service
required to meet the public need.
State responsibility in event of disaster: All State departments and
agencies are responsible for providing disaster support and assistance to
the County and individuals in the County of Hawai'i in accordance with their
statutory authority, functions, resources and capabilities.
Federal responsibility: In the event that the President declares a federal
disaster, the Department of Homeland Security's Federal Emergency
Management Agency (FEMA) becomes responsible for civil defense and
disaster assistance in peacetime emergencies.
Other organizations: By law, the American Red Cross operates under
Federal Charter as the agency responsible for meeting the emergency
needs of disaster victims and coordinating with County and State Civil
Defense, Federal, and nongovernment agencies.

Overview of Civil Defense -
Disaster Response Organization
County level: The State Director of Civil Defense, with the approval of the
Hawai'i County Council, appoints a State Deputy Director of Civil Defense.
This Deputy Director is the Mayor of Hawai'i County. The County Charter
provides for a Civil Defense Agency, which is headed by a Civil Defense
Administrator who acts as the assistant to the Deputy Director of Civil
Defense. The Civil Defense Administrator is responsible for the prompt
and efficient execution of the entire EOP.
State level: The State Director of Civil Defense is the Adjutant General
(TAG), who is also the commanding officer of the Hawai'i National Guard.
Appointed by the TAG is the Vice Director of Civil Defense.

Timeline
7:07 a.m. Earthquake, 6.7 magnitude
7:09 a.m. Civil Defense EOC opened by Deputy Director (DD)
of Civil Defense. (Administrator was off island on
National Guard training.)
7:10 a.m. DD conferred with Gerard Fryer of the Pacific
Tsunami Warning Center (PTWC) over the HAWAS
and received confirmation that no tsunami, local or
Pacific-wide, was generated.
7:11 a.m. PTWC issues Tsunami Bulletin #1 stating no
tsunami generated.
7:11 a.m. Declared a state of emergency and notified State
Civil Defense
7:12 a.m. Police Dispatch notified by DD that no tsunami was
generated, and asked to notify Fire Dispatch and all
stations that there is no tsunami threat. Instructions
are to disseminate information to all districts.
Instructions were also given to execute earthquake
Standard Operating Procedures.
7:16 a.m. Police Dispatch notified all districts that no tsunami
was generated.
7:20 a.m. First radio message given to commercial radio
stations by DD for broadcast - no tsunami threat, as
well as protective and precautionary measures to be
taken.
7:30 a.m. EOC is 50% staffed.
10:00 a.m. EOC is 100% staffed.

Emergency Operations Center (EOC)
Function: The function of the EOC is to provide for the direction and
coordination of all County Civil Defense operations necessary to
meet the public need when a natural or man-made disaster
threatens or occurs anywhere in the County of Hawaii. (From the
County of Hawaii Emergency Operations Plan)
Procedure: All civil defense personnel, first responder agencies and
cabinet members are expected to report to the EOC immediately
whenever an earthquake is felt.

WHEREAS, Chapter 127, Hawaii Revised Statutes, as amended, and Chapter 128,
Hawai'i Revised Statutes, as amended, provide for the establishment of County organizations for
disaster relief with a deputy director in charge of each political subdivision; and
WHEREAS, the Mayor of the County of Hawaii has been appointed as the Deputy
Director of Civil Defense of the County of Hawaii; and
WHEREAS, Chapter 7, Articles I and 2 of the Hawai'i County Code, establishes a Civil
Defense Agency within the County of Hawai'i and prescribes its powers, duties, and
responsibilities, and Section 13 23 of the Hawaii County Charter empowers the Mayor of the
County to declare emergencies; and
WHEREAS, at approximately 7:08 a.m HST on October 15, 2006 an earthquake measuring 6.3
magnitude on the Richter scale has occurred. The Pacific Tsunami Warning Center has reported
epicenter of this earthquake to be located at approximately 6 miles NNW of Pu'uanahulu, Hawaii.
w•+ The Pacific Tsunami Warning Center further reports that after-shocks may occur; and
WHEREAS, due to the possibility of property damage and/or bodily injury to residents of
Hawaii Island, and the need for government agencies and representatives from the private sector
to mobilize and provide immediate services to our island residents, a Civil Defense state of
emergency is authorized pursuant to Chapters 127 and 128, Hawaii Revised Statutes, as
amended, and Chapter 7, Hawaii County Code.
NOW, THEREFORE, I, HARRY KIM, Mayor of the County of Hawaii, do hereby
proclaim and declare that a state of emergency exits for the entire Hawai'i Island, effective 7:08
a.m HST, October 15, 2006, and continuing thereon until further act by this office.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the Seal of the County of

PROCLAMATION
By the authorityvested in me as Governor bythe Constitution and laws of the State of
Hawaii, in order to provide relief for disaster damages, losses, and suffering, and to protect the
health, safety, and welfare of the people, I, LINDA LINGLE, Governor of the State of Hawaii,
hereby determine, designate and proclaim as follows:
WHEREAS, an earthquake measuring 6.5 on the Richter scale occurred on October 15,
2006 with an epicenter located near Pauanahulu in the county of Hawaii, was felt throughout the
state and has caused damage to structures. private and public, and public roads and Wgltways in
the counties of Hawaii, Maui, Kauai, and the City and County of Honolulu, State of Hawaii; and
WHEREAS, this occurrence of a severe, sudden, and extraordinary event has caused
damages, losses, and suffering of such character and magnitude to have affected the health,
welfare, and living conditions of a substantial number of persons, and to have affected the
economy of the State, and is of such a nature as to warrant rehabilitative assistance from the
State; and
WHEREAS, the Legislature of the State of Hawaii has appropriated from the general
revenues of the State, monies as may be necessary for expenditure by or under the direction of
the Governor for the immediate relief of the conditions created by the disaster; and
WHEREAS, in expending such monies, the Governor may allot any portion to any
agency, office, or employee, fcderal, state, or county for the most expeditious and efficient relief
of the conditions created by the disaster, and
WHEREAS, pursuant to section 127-11, Hawaii Revised Statutes, the Governor is
authorized to determine whether a major disaster has occurred and authorize the expenditure of

WHEREAS, pursuant to section 121-30, Hawaii Revised Statutes, the Governor may
order the Hawaii National Guard, or any part thereof, into active service for assistance to civil
authorities in disaster relief, civil defense, averting any inunineut public danger and threat, and to
insure the compliance with the civil laws of the State of Hawaii; and
WHEREAS, pursuant to section 209-2, Hawaii Revised Statutes, the Governor is
authorized to make a determination whether a disaster has occurred, thereby making available
housing relief, under part H of chapter 209, Hawaii Revised Statutes, and commercial and
personal loans under part III of chapter 209, Hawaii Revised Statutes, for disaster relief and
rehabilitation; and
WHEREAS, section 127-10, Hawaii Revised Statutes, provides that when sections 127-1
to 127-9, Hawaii Revised Statutes are not in effect, the Governor may exercise any and all
powers contained in chapter 128, Hawaii Revised Statutes, in order to provide other disaster
relief and that all provisions of the law provided in chapter 128, Hawaii Revised Statutes, during
such period are made applicable to other disaster relief, including without limitation, provisions
making or authorizing appropriations or expenditures; and
WHEREAS, pursuant to Act 35, Regular Session Laws of Hawaii 1961, sections 127-1
to 127-9, Hawaii Revised Statutes, have been indefinitely suspended and are not in effect, the
provisions of Chapter 128, Hawaii Revised Statutes, are applicable to other disaster relief; and
WHEREAS, pursuant to section 127-10, Hawaii Revised Statutes, other disaster relief
includes, but is not limited to the preparation for and the carrying out of all functions, other than
functions for which military forces are primarily responsible, to minimize and repair injury and
damage resulting from disasters caused by fire, flood, tidal wave, volcanic eruption, earthquake,
or other natural causes and major disasters caused by acts of man, including but not limited to,
massive oil spills, nuclear accidents, airplane crashes and civil disturbances; and
WHEREAS, pursuant to section 128-8(4), Hawaii Revised Statutes, the Governor is

" ` authorized to suspend any law which impedes or tends to impede or is detrimental to the

expeditious and efficient execution of, or conflict with, disaster relief or other emergency
functions; and
WHEREAS, pursuant to section 128-9(8), Hawaii Revised Statutes, the Governor is
further authorized to relieve hardship and inequities or obstructions to the public health, safety,
and welfare found by the Governor to exist in the laws by suspending laws in whole or in part, or
by alleviating the provisions of laws on such terms and conditions as the Governor may impose;
and
WHEREAS, pursuant to section 128-10(10), Hawaii Revised Statutes, the Governor may
suspend chapter 103D and sections 103-50,103-53, 103-55, 105-1 to 105-10, and 464-4, Hawaii
Revised Statutes, and I find that these provisions, in whole or in part, impede or tend to impede
the expeditious discharge of emergency disaster relief functions for this occurrence and that
compliance therewith is impracticable due to existing conditions; and
yr,. WHEREAS, pursuant to section 128-10(5), Hawaii Revised Statutes, the Governor is
fiuther authorized to order and direct government agencies, officers, and employees, state or
local, to take such action and employ such measures for law enforcement, medical, health, fire
fighting, Traffic control, warnings, and signals, engineering, rescue, construction, emergency
housing, and other welfare, hospitalization, transportation, water supply, public information,
training, and other civil defense and emergency functions as may be necessary, and utilize the
services, materials, and facilities of the agencies and officers; and
WHEREAS, pursuant to section 128-10(11), Hawaii Revised Statutes, the Governor may
appoint, employ, train, equip, and maintain, with compensation, or on a volunteer basis without
compensation and without regard to chapters 76, 78, and 88, such agencies, officers, and other
persons as the Governor deems necessary to carry out emergency disaster relief functions;
determine to what extent any law prohibiting the holding of more than one office or employment
applies to the agencies, officers. and other persons; and subject to section 128-15, provide for and
effect the interchange of personnel, by detail, transfer, or otherwise, between the State and any

political subdivision, or among any agencies or departments of the State; and
WHEREAS, pursuant to section 128-10(15), Hawaii Revised Statutes, the Governor may
take any and all steps necessary or appropriate to carry out the proposes of chapter 128 and to
provide for civil defense and other emergency functions; and
NOW, THEREFORE, I LINDA LINGLE, Governor of the State of Hawaii, hereby
determine that a major disaster and catastrophe contemplated by sections 127-11, 121-30, 209-2,
128-8(4), 128-9(8), 128-10(5), 128-10(10), 128-10(11),128-10(15), and parts n and M of
chapter 209, Hawaii Revised Stanttes, have occurred on the above dates and in the above areas in
the State of Hawaii, and do hereby proclaim these areas to be disaster areas for the purpose of
authorizing the expenditure of State monies as appropriated for the speedy and efficient relief of
the damages, losses, and suffering resulting from the disaster, and hereby authorize and invoke
the following measures under the Hawaii Revised Statutes:
1. Section 127-11, major disaster fund.
2. Part lI of chapter 209, housing relief.
3. Part III of chapter 209, commercial and personal loans.
4. Sections 128-8(4), 128-9(8), and 128-10(10), and in order to provide emergency
disaster relief and, to the extent necessary to repair, restore, rebaild, with any
necessary improvements, any public structures, roadways or bridges damaged by
the earthquake, I hereby suspend as allowed by federal law, the following statutes:
a. Chapter 6E, historic preservation except for those provisions relating to
burial sites.
b. Chapter 89, collective bargaining in public employment.
C. Chapter 89C, public officers and employees excluded from collective
bargaining.
d. Section 102-2, contracts for concessions in government buildings; bid
requirements.
C. Section 103-50, building design to consider needs of persons with
disabilities.
f. Section 103-53, contracts with the State or counties; tax clearances,

5. Section 121-30, Hawaii Revised Statutes, active service of the National Guard;
and I hereby order the National Guard into active service effective immediately,
and the Adjutant General of the Hawaii National Guard is DIRECTED AND
AUTHORIZED to activate such units of the Hawaii National Guard as may be
necessary to assist and aid civilian authorities in disaster relief and in averting any
imminent public danger and threat and to insure the compliance with the civil
laws of the State of Hawaii.
6. Section 128-10(5), Hawaii Revised Statutes, and in order to provide emergency
disaster relief, I hereby direct all state and county agencies and officers to
cooperate with and extend their services, materials, and facilities as maybe
required to assist in all efforts to eliminate the danger.
I FURTHER DECLARE that a disaster emergency relief period shall continence October
15, 2006 and continue until such an appropriate time for termination, as I will determine. I will
set a date after which no further applications for assistance under the law shall be accepted,
which date Imay extend for a reasonable time for good cause.

Public Broadcasts: On October 15, 2006, the first radio
message was transmitted to commercial radio
stations at 7:20 a.m. to inform the public that no
tsunami was generated, as well as protective and
precautionary information.
Continuous updates were made from 7:20 a.m.,
with a total of nine messages issued by 9:00 p.m.
Various stations came on line at different times due
to problems of power or transmitters. The majority
of Hilo stations were on line by 7:30 a.m. West
side, except for one AM station which commenced
at 8:00 a.m., did not come on line until between
11:00 a.m. and 12:00 noon.

INSTRUCTIONS FOR THE APPLICATION
FOR DISASTER REMISSION OF TAXES
EARTHQUAKE ON OCTOBER 15, 2006
This application is only for real property taxes paid, or due. In all cases, the
amount of remission will not reduce the total annual taxes to less than the
minimum tax for the parcel. If you are currently paying the minimum tax, do not
complete this form as no remission will be calculated. The remission calculation
will be based on the balance of the tax year, October 15, 2006 to June 30, 2007.
Also, this is a remission on real property taxes. The Real Property Tax Office
does not assess, or tax, improvements to your property such as retaining walls,
fences, landscaping, and driveways. Damage of this type item would not result in
any remission of taxes.
Steps to complete the application:
1. Fill in the Tax Map Key Number of the parcel. This can be obtained from your
last tax bill or assessment notice.
2. Fill in the name and address of the Claimant along with their telephone
numbers. Telephone numbers are very important so that the tax office or
appraiser can contact you if information is missing, or if an inspection is
necessary.
3. Fill in the type of disaster (Earthquake) and date (October 15, 2006).
4. In your own words, describe exactly what was damaged, Then in the section
listing the major building components, fill in the approximate percentage of
each category that was damaged. If a particular component was not
damaged, leave it blank. For example, if half of the windows in the house
were broken you would put 50% in that box.
5. Sign, date and mail in the application by June 30, 2007.

AN EMERGENCY ORDINANCE GIVING THE MAYOR OF THE COUNTY OF HAWAII
EMERGENCY POWERS TO WAIVE CERTAIN REQUIREMENTS AS PROVIDED BY
CHAPTERS 3 (ADVERTISING & SIGNS), 5 (BUILDING), 9 (ELECTRICITY), 17
(PLUMBING), 20 (WAIVER OF TIP FEES FOR LANDFILL FOR EMERGENCY
DEBRIS), 22 (STREETS & SIDEWALKS), AND 25 (ZONING) OF THE HAWAII
COUNTY CODE
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION I. Emergency Ordinance. This is an emergency ordinance
necessitated by the damages incurred by the people of the County of Hawai'i due to the
earthquake occurring on October 15, 2006. As a result of said earthquake, many
structures and buildings were damaged. This ordinance recognizes that there is a
pressing need to make repairs and to reconstruct buildings and structures so damaged
as a result of the earthquake. To impose all the requirements of Chapters 3, 5, 9, 17,
20, 22 and 25 of the Hawai'i County Code (as amended), will impose unnecessary and
unwarranted hardships upon the people of the County of Hawai'i.
This ordinance is adopted pursuant to Section 3-11, County Charter, County of
Hawai'i, in order to diminish the difficulties and hardships which would result from
insistence upon strict compliance with Chapters 3, 5, 9, 17, 20, 22 and 25 of the Hawai'i
County Code (as amended).
SECTION 2. Purpose. To afford any person, partnership, or corporation in the
County of Hawai'i that was affected by the October 15, 2006 earthquake the opportunity
to repair signs, driveway approaches, sidewalks and other private improvements and to
rebuild damaged structures and buildings without having to strictly comply with all
requirements of Chapters 3, 5, 9, 17, 20, 22 and 25 of the Hawai'i County Code
(as amended).
SECTION 3. Applicability. This ordinance shall be applicable only to those
persons, partnerships, and corporations, which buildings or structures were directly
affected by the October 15, 2006 earthquake.
SECTION 4. Powers Granted. The Mayor of the County of Hawai'i, through his
designated representatives, shall have the power to waive certain requirements of
Chapters 3, 5, 9, 17, 20, 22 and 25 of the Hawai'i County Code (as amended), including
but not limited to permit fee, structural, setback and parking requirements. The Mayor
shall cease to issue any waivers pursuant to this ordinance sixty (60) days after the
effective date of this ordinance.
SECTION 5. Nonconforming Buildings and Structures. No waiver granted shall
be used to construct a nonconforming building; provided, however that if a building or
structure was nonconforming with respect to ordinance requirements prior to October
15, 2006, the Mayor shall have the power to waive ordinance requirements with respect
to those buildings if doing so does not enlarge the extent to which such buildings are in
nonconformance with Chapters 3, 5, 9, 17, 20, 22 and 25 of the Hawai'i County Code
(as amended).
SECTION 6. Revocation of Waivers. All waivers issued pursuant to this
ordinance shall be subject to revocation at any time for noncompliance with the
conditions and safeguards attached thereto, or for noncompliance with this ordinance.
err SECTION 7. Appeal. Any action taken by the Mayor pursuant to this ordinance
may be appealed to the County Council.
SECTION 8. Duration. This ordinance, including any amendments made after
adoption, shall automatically stand repealed as of the 61St day following the date of
adoption of the original ordinance.
SECTION 9. Effective Date. This ordinance shall take effect upon its approval.
