From Dr. Eric Tallan Chairman Higa, I am Dr Eric Tallan, owner of TMK 3-7-5-2-51 which is located immediately above the proposed Coffee Estates Subdivision. For nearly three years now we have been developing an organic farm in conjunction with the NRCS. Over a thousand trees have been planted, thirty producing raised beds are in operation and a large greenhouse is under construction. I am committed to responsible, sustainable agriculture and intend to relocate within 7 years, relocating my family to the Island permanently to practice head and neck surgery (ENT). I have no particular view on the proposed subdivision as I am not fully aware of all the local circumstances that surround it. However I want to ensure that you are aware of my communication with Mr. Wheelock whom, I understand, represents the owner. Mr. Wheelock approached me some time ago seeking my approval for a possible utility .easement across my property from the Mamalahoa Highway. I advised him that I would need to retain legal council to research the proposal if he decided to utilize a route traversing our farm, but that I had no objection to the concept if it was mutually beneficial. Mr. Wheelock also inquired about access across my property to the highway “for emergency situations”. As a Medical Practitioner I would not stand in the way of true emergency access but again, I would need to seek legal council and perform due diligence if he decided such access was indeed necessary. Formal negotiations never occurred and no agreements were ever formalized. Furthermore, my neighbors have advised me that even if Mr. Wheelock had access across our farm, they would not support his use of our mutually owned road to the highway. (I can not, and have not granted access across the community road.) 1 Comm. Cr. Ref. To. 6 Ref. Date More recently, Mr. Wheelock has advised me that he has alternate emergency road access and has not yet made a final decision regarding a utility route. Living off island, I had no idea of the controversy surrounding the proposed development! I have recently been advised of my neighbor's adamant opposition to the project. Ultimately we must all live in peace, and to that end, we can not provide access until all parties reasonable concerns are met. In summary, we have no agreement real or implied except as above, but we would be willing to negotiate with all interested parties to find a responsible, mutually acceptable solution. The purpose of this letter it to clarify our position as I have been advised that there may be some miscommunication or distortion of the facts.
