To Chairman Higa and County Council
Dear County Council,
The issue has been raised whether a bill can be agendized and noticed for a reading before the County
Council has met an agreed-upon pre-condition, (public hearing).
While the public hearings may have been scheduled at the time the bills were agendized and noticed, the
pre-condition for further deliberation and decision had not yet been met.
The question is whether Bill 251 and Bill 309 are legally on the Nov. 15 agenda.
Has this matter been resolved without doubt? It should not be presented to the public as legal unless it
absolutely is legal.
Certainly, it would be unseemly to proceed with haste on these two Bills which affect so many citizens,
and find out later that procedure was incorrect. The rights of citizens would not be well-served. Liability
suits impacting the landowners' and developers' interests could also arise if decisions were made
following improper protocol.
Therefore, I am entering this testimony that citizens expect that the County Council will be in total
compliance with legally proscribed information practices regarding the above issue in relation to Bills
251 and 309.
