REFERRALS
Comm. 1210: AN ORDINANCE AMENDING CHAPTER 14, ARTICLE 4, HAWAII COUNTY
(Bill 365) CODE 1983 (2005 EDITION), RELATING TO SMOKING IN CERTAIN PLACES
IN THE COUNTY OF HAWAII (prohibiting smoking, use of tobacco products and
the disposal of cigarettes at Kahalu`u Beach Park and includes a penalty of $100 for
any violation)
From Councilmember Virginia Isbell, dated November 15, 2006, transmitting the
above bill. The key points of the bill are 1) definitions for "cigarette" and "tobacco
products"; 2) adding Kahalu`u Beach Park as area where cigarettes or tobacco products
are prohibited; and 3) a $100 fine for any violation at Kahalu`u Beach Park, verses a
violation at any other site is a $25-$50 fine.
Comm. 1211: Presentation of a video tape submitted by a member of the public regarding Res. 46-O1,
funding for Marijuana Eradication, entered into public record as Comm. 102.18, dated
March 9, 2001.

Comm. 425: AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 1, SECTION 15-7, OF
(Bill 147, THE HAWAII COUNTY CODE 1983 (2005 EDITION), RELATING TO PARKS
Draft 2) AND RECREATION (changes the penalty for violations of any provision in
Chanter 15 by reducing the maximum imprisonment from ninety davs to thirty davs)
From Councilmember Bob Jacobson, dated October 17, 2005, transmitting the above
bill. The Prosecutor's Office staff requested this amendment, with the impetus being
feedback from judges and juries in the court system: imprisonment for failure to obtain
a camping permit is so extreme that individuals cited for a violation are compelled to
challenge the citations in court; and large number of these cases are not viewed as a
good use of the court's time.

lobbyist {Article 15, Section 2-91.3(b), Hawaii County Code}. A lobbyist means "any individual
engaged for pay or other consideration who spends more than five hours in any month or $275 in any
six-month period for the purpose of attempting to influence legislative or administrative action by
communicating or urging others to communicate with public officials." {Article 15, Section
