Subject: Testimony supporting amendment to Chapter 14, Article 4, Kahalu'u Beach Park
Dear Hawaii Island City Council Members:
I would like to testify in favor of Bill 365, an ordinance amending Chapter 14, Article 4, Hawai'i County Code 1983
(2005 edition), relating to smoking in certain places in the county of Hawai'i.
As a member of the Puna Community Develoment Plan's Working Group on Land Use (Preserveing Open Space
subcommittee), a supporter of the "2%" ordinance that passed during the November elections, and an advocate
for smokefree Hawaii, I strongly urge restriction of smoking, use of tobacco products, and disposal of ALL forms
of cigarettes at Kahalu-u Beach Park.
I recommend that the proposed penalty be reduced from $100 to the $25-$50 fines that apply to other sites
covered under the law.
Given the hearings and other media attention related to the smoke-free ordinance on the Big Island and more
recently the law applying to the state, the Council is acutely aware of the negative health and hygiene
consequences of smoking in work and other public places. As more trees and foliage are destroyed by
developers, protecting the air quality in Hawaii assumes even greater importance.
