Your Committee on Public Safety and Parks and Recreation, to which was referred
Communication No. 1210/Bill No. 365 reports as follows:
Bill No. 365, transmitted by Council Member Virginia Isbell, via Communication No. 1210,
dated November 15, 2006, amends Chapter 14, Article 4, Hawaii County Code 1983 (2005
EDITION), relating to smoking in certain places in the County of Hawaii.
The purpose of this Bill is to prohibit smoking, use of tobacco products and the disposal of
cigarettes at Kahalu'u Beach Park and includes a penalty of $100 for any violation.
Council Member Isbell introduced a Draft 2 of the Bill which amends Section I definition for
"Tobacco products" and Section 2 to include all of Section 14-21 to the new subsection.
Diane Noda from the Corporation Counsel commented that the Youth Fisheries Council
members wanted to reduce the fine back to $25-$50 as they arbitrarily picked the $100 figure
then later realized the fines for violating the ordinance at every other location was only $25-$50.
Virginia Isbell asked the Youth Fisheries Council members to discuss this among their
membership and let her know how they felt about the amount of the fine, if they wanted to
change it and why.
Your Committee on Public Safety and Pazks and Recreation is in accord with the purpose and
intent of Bill No. 365 as amended to Draft 2 and recommends it pass first reading.
