Your Committee on Public Safety and Parks and Recreation, to which was referred Bill No. 147
Draft 2, reports as Follows:
Bill No. 147 Drafr 2, transmitted by Council member Jacobson, via Communication No. 425,
dated October 17, 2006, amends Chapter 15, Article 1, Section 15-7, of the Hawaii County
Code 1983 (2005 EDITION), relating to Parks and Recreation.
The purpose of this Bill is to change the penalty for violations of any provision in Chapter I S by
reducing the maximum imprisonment from ninety days to thirty days.
Deputy Prosecutor Mitch Roth commented that he supports Bill 147 Draft 2 because individuals
facing the current possible penalties can request a jury trial, potentially taking up the courts time
and resources. He also added that it was never the intent of the judiciary to dispense long
sentences and that this amendment would mirror the state laws for a petty misdemeanor.
Your Committee on Public Safety and Pazks and Recreation is in accord with the purpose and
intent of Bill No. 147 Draft 2 and recommends it pass first reading.
