For your information, we have no objections to your combining the annual reports for the project development. As a reminder, please review your conditions for compliance deadlines. More specifically, that the zoning for the subject properties are not in effect until Condition B of Change of Zone Ordinance No. 88-158, regarding water, is met. Also, SMA Use Permit No. 336, Condition No. 2, requires that construction plans be submitted and Final Plan Approval for Kikaua Point Park be secured within 12 months from the execution of the lease document with the Department of Land and Natural-Resources. ~ui~. (HRA), this letter report is being submitted to provide a status of the project development and its compliance with the conditions of approval for the subject Ordinance and SMA Use Permits. Please note that although the anniversary date of the SMA Use Permit No. 311 is January 31, we have included reporting requirements for this permit as part of the status report to avoid duplication of efforts. Additionally, Conditions 12 of SMA Use Permit No. 336, which covers the development of a public shoreline park (Kikaua Point Park) and supporting facilities, requires an annual progress report be submitted in conjunction with that of SMA Use Permit No. 311. In this respect the reporting requirements for SMA Use Permit No. 336, Condition 12 aze also being addressed within this report. HdW.Vi 9(pYU TELMHONk.: ftlUN) P61-9335 FA.\: I8U8) 461-i9H4 Ms. Y>rginia Goldstein SUBJECT: STATUS REPORT FOR REGENT KONA COAST RESORT (KUKIO BEACH CHANGE OF ZONE ORDINANCE 88-159 AND SPECIAL MANAGEMENT AREA USE PERMITS NOS. 273, 311 AND 336 TMK: 7-2-4 PORTIONS OF 5 & 16 October 31, 1997 Page 2 The ordinance and permits pertaining to the subject project include: • Ordinance 88-158, which established the conditional zoning for the approximately 675-acre project area (effective date -October 27, 1988). • SMA Use Permit No. 273 which allows for the development of a 19-lot subdivision, golf course, golf clubhouse, plant nursery, infrasUucture and other support facilities (effective date - October 27, 1988, concurrent with Ordinance 88-158). • SMA Use Permit No. 311, which allows for the development of the 350-unit Regent Kona Coast Hotel and supporting facilities, a 43± lot single family residential subdivision, and related improvements, (effective date -January 31, 1991); and • SMA Use Permit No. 336 which allows for the development of a public shoreline pazk (Kikaua Point Park) and supporting facilities on an approximately 7.5 acre site, (effective date - December 10, 1992). Status of Development Condition 2 of SMA Use Permit No. 311 requires that plans for the hotel development be submitted to the Planning Department for Seal plan approval within 18 months of the SMA Use Permit approval. On September 14, 1995, the County Planning Commission granted an extension of five (5) years, until September 14, 2000, in which to secure final plan approval for the resort hotel development. The reasons cited for this extension request were the pending litigation related to the property ownership and the continuing weak economic conditions. Since the time of the previous status report (October 29, 1996), the outstanding legal issues have largely been resolved. HRA is cwrently working to resolve outstanding issues pertaining to the water system development and distribution, and the development of a utility corridor on adjacent lands. The purpose of this corridor is to provide for the transmission of the project related utilities (water, power and communication systems) that have been developed or are planned on lands previously owned by HRA and located mauka of the project site. HRA expects these issues will be fully resolved within the next year. Concurrent with this effort, HRA will be seeking a new joint development partner and hotel operator. Ms. Virginia Goldstein SUBJECT: STATUS REPORT FOR REGENT KONA COAST RESORT (KUKIO BEACH) CHANGE OF ZONE ORDINANCE 88-159 AND SPECIAL MANAGEMENT AREA USE PERMITS NOS. 273, 311 AND 336 TMK: 7-2-4 PORTIONS OF 5 & 16 October 31, 1997 Page 3 Kikaua Point Park On December 10, 1992 and April 27, 1993, HRA received SMA Use Permit and Conservation District Use Permit approval, respectively, for the development of Kikaua Point Park. Based on an agreement with the Boazd of Land and Natural Resources, HRA has agreed in principle to relinquish to the State its claim of ownership over the approximately 7.5 acre site in exchange for along-term lease or "term easement" for the development and management of the area as a public shoreline park. The lease rent for the pazk area would be determined based on an independent assessment for which HRA has provided funds to DLNR. Once the State has completed its appraisal, we expect that a lease agreement can be reached that is mutually agreeable to both parties. Improvements for this portion of the project, which would be implemented by the developer, are expected to commence concurrently with the adjacent hotel development. Other than the above-mentioned activities, there has been no change to the status of development for the Regent Kona Coast Resort project.
