(808) 961-8327 • Fax (808) 961-8630 ~ ~ December 6, 2006 c'--', -v HONORABLE PETE HOFFMANN COUNCIL CHAIRPERSON ~ AND MEMBERS OF THE COUNTY COUNCIL w HAWAII COUNTY COUNCIL COUNTY OF HAWAII HILO HI 96720 SUBJECT: AN ORDINANCE GIVING THE MAYOR OF THE COUNTY OF HAWAII THE AUTHORITY TO WAIVE CERTAIN REQUIREMENTS AS PROVIDED BY CHAPTERS 3 (ADVERTISING & SIGNS), 5 (BUILDING), 9 (ELECTRICITY), 17 (PLUMBING), 20 (WAIVER OF TIP FEES FOR LANDFILL FOR EMERGENCY DEBRIS), 22 (STREETS & SIDEWALKS), AND 25 (ZONING) OF THE HAWAII COUNTY Transmitted herewith for the Council's approval is a second emergency ordinance authorizing the Mayor to waive certain requirements of the Hawaii County Code in order to expedite repairs and reconstruction of buildings and infrastructure damaged by the earthquake that struck Hawaii Island the morning of October 15, 2006. The Council passed a similar ordinance, Ordinance No. 06-130 on October 24, 2006. This ordinance is automatically repealed on the 61st day following its adoption, which would be December 24, 2006. We are proposing the new ordinance to provide additional time for people to obtain the necessary permits to repair damages received from the October 15, 2006, earthquake. We have building owners, because of the extent of damage, who will not be able to apply by December 24, 2006 for their needed permits and therefore, eligible for the waiver. I ask that this be waived to full Counci] in order to provide needed assistance to our citizens. APPROVED: RUCE C. McCLURE, P. E.
