Change of Zone Ordinance No. 95 55 (REZ 792)

Subject: Time Extension Request to Comply With Condition B

This is to acknowledge receipt of your letter dated December 12, 2006, requesting a time extension to
comply with Condition B (secure Final Subdivision Approval) of Change of Zone Ordinance No. 95 55
(REZ 792). The effective date of Change of Zone Ordinance No. 95 55 is April 26, 1995. Condition B of
Change of Zone Ordinance No. 95 55 states that final subdivision approval be secured within five years
from the effective date of the ordinance (or April 26, 2000). A five-year administrative time extension to
comply with Condition B was granted until April 26, 2005. Subdivision 2003-0092 received Tentative
Approval on December 17, 2003.
The time extension request is beyond the allowance of an administrative time extension based on
Condition G and will need to be brought before the Planning Commission and the Hawaii County Council
for their approval.
You will need to submit your request, with reasons, along with 20 copies of that request to the Planning
Commission with a $250 filing fee. A public hearing will be held by the Planning Commission.

We would like to request an extension of six (6) months from the date of this letter
regazding the change in zoning for the above referenced subdivision. Delays in the
approval process has prevented us from securing the construction bond for the project up
to this point. We would like to secure the construction bond and receive County of
Hawaii Planning Department approval within the six month extension period.
