b) Estimated construction date for the project was planned by the State Revolving Fund
(SRF) for 8/97. Delays to the project disrupt the cash flow of the SRF and could cause the
project to he removed from the priority list. The County would then lose the benAefit of the

CHAPTER I
INTRODUCTION
The Wastewater Facilities Plan, Hilo District, South Hilo,
Hawaii, developed in 1980 is a comprehensive planning document
that addressed all aspects of wastewater infrastructure for the
Hilo District. The environmental impact statement prepared in
conjunction with the development of the plan described the
problem the proposed systems are designed to address, the various
components of the system, alternative approaches to addressing
the problems, the environmental setting, and probable impacts and
mitigating measures.
Since the 1980 plan and EIS were prepared, several changes
have been made to the original planned system that exact the
preparation of updated documents. This plan herein incorporates
the original 1980 Facilities Plan by reference and focuses on the
need for changes in the design and location of the proposed
treatment plant, pump station, and trunk sewers, and on
alternative treatment methods.
The mechanism for demonstrating the attainment of water
quality goals in the most cost-effective manner is the Wastewater
Management Plan, also called a facilities plan, which takes into
account engineering and environmental impact factors. Specific
guidelines for these plans have been promulgated by the
Environmental Protection Agency (EPA), and those guidelines
govern the scope and direction of this facilities plan.

discharge requirements, the impact of proposed actions on water
quality, and the cost-effectiveness of the subject facilities in
meeting water quality goals. The impetus for such planning
efforts is two-fold:

WHEREAS, the federal government, by and through the
Environmental Protection Agency (EPA), has offered the County of
Hawaii a grant award in the amount of $9,023,600.00 to assist in
the construction of the Hilo Wastewater Treatment and Conveyance
Project, Phase I, which amount may be increased depending upon the
actual cost of the project; and
WHEREAS, as a condition of receiving said grant, the County
shall be required to execute an EPA assistance agreement and
adhere to the special conditions incident thereto; and
WHEREAS, as a special condition to the receipt of such
assistance grant, the EPA shall require the County to agree to
build the following projects over the course of several years:

WHEREAS, adherence by the County to the above special
condition will necessarily involve the encumbrance of funds from
the appropriations of later fiscal years; and
WHEREAS, pursuant to section 10-11 of the Hawaii County
Charter, any contract or obligation requiring the payment of funds
from the appropriations of a later fiscal year or of more than one
fiscal year shall be made or approved by resolution; and
WHEREAS, the council finds that the receipt of said federal
funds is of such importance to the public so as to justify the
encumbering of funds from the appropriations of-later years.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that it authorize the County to enter into an assistance
agreement with EPA far the receipt of the assistance grant for the
construction of the Hilo Wastewater Treatment and Conveyance
Project, Phase I and, by so doing, approve of the conditions
incident thereto.

e. GENERAL CONDITIONS
The recipient covenants and agrees that it will expeditiously initiate and timely complete the project work for
which assistance has been awarded under this agreement, in accordance with all applicable provisions of 40 CFR
Chapter I, Subpart B. The recipient warrants, represents, and agrees [ha[ it, and its contractors, subcontractors,
employees and representatives, will comply with: (1) all applicable provisions of 40 CFR Chap ter I, Subchapter B,
[NCLUCTNG BUT NOT LIMITED TO the provisions of Appendix A to 40 CFF Part 30, end (2) any special
conditions set forth: in this assistance agreement or any assistance amendment pursuant to 40 CFR 30.425.

b Conveyance Project, Phase I
SPECIAL CONDITIONS:
1. Should the discovery of potential archaeological or historical resource occur during
construction, all works in the area of tie ;ind will stop and the said consultant
will be called in to evaluate the situation and make recommendations to the State
' Historic Preservation Officer, Department of Land and Natural Resources, State of
Hawaii. Said Historic Preservation Officer will determine what will be necessary for
construction to proceed.
2. No portion of this award may be used for lobbying or propaganda purposes as
prohibited by 18 U.S.C. Section 1913 or Section 607(a) of Public Law 96-74.
3. The recipient agrees to submit to DOR, WB a completed Form 334 within 15 days
following the end of each Federal fiscal year quarter during which the recipient or
its contractors award any subagreements of supplies, equipment, construction or
services to accomplish Federal assistance programs.
4. The grantee shall negotiate all engineering consulting subagreements for CY work and
services during construction in accordance with 40 CFR Part 31, Uniform and
Administrative Requirements for Grants and Cooperative Agreements to State and Local
Governments, promulgated Narch 11, 1988, sad 40 CFR Part 35, Grants for Construction
of Treatment Works, Final and Interim Rule (published February 17, 1984 is the
Federal Register), and submit them to the Hawaii Department of Health, Wastewater
Branch for approval. No payments for the affected engineering work will be made to
the grantee under this grant until the subagreements have been approved. This
condition does not affect that portion of the grant related to the allowance for
planning or design work.
5. The recipient agrees that it will comply with the provisions of ONB Circular A-128
governing the audit of State and local government and Indian tribe federal assistance
recipients for fiscal years that begin after October 1, 1988. (This requirement is
in 40 CFR Par[ 31, Appendix A.)
6. The grantee will provide to EPA/State (in writing) a detailed description of the
design performance standards which the project is expected to meet under start-up
conditions and at ultimate design conditions. The data shall be submitted as part of
the plan of operation prior to the fifty percent (SOS) grant payment.
The grantee will advise EPA/State (in writing) of the date of initiation of
operation. Failure to do so will cause grant payments [o be withheld in accordance
with 40 CFR Part 31.
On the date one year after initiation of operation of Che project; Che grantee shall
certify to EPA/State (in writing) whether or not the project-is performing in
accordance with design performance standards previously submitted and with the
enforceable requirements of the Clean Water Act. If the project cannot meet these
standards or [he enforceable requirements of the Clean Water Act, the grantee must
submit a corrective action report and a schedule far bringing the project into
compliance (40 CFR Part 35.2218).
^nd the Environmental Protection Agency agree, pursuant to Section
203(a)(2) of the Clean Ya[er Act, chat only those items specified as "eligible" on
the Plans and Specifications Approval Form dated July 11, 1989 are eligible for
Federal participation in accordance with 40 CFR Part 35.2250.
8. The grantee shall acquire and maintain any flood insurance made available to it
under the National Flood Insurance Act of 1968, as amended, for the useful life of
the project.
This condition shall not be applicable if the project location is outside the
boundaries of a special flood hazard area delineated on a flood Nazard Boundary Yap
of Flood Insurance Rate Hap which has been issued by the Department of Housing and
Urban Development, Federal Insurance Administration. This condition shall not be
applicable if the total value of improvements insurable under the National Flood
Insurance Aet is leas than $10,000.
9. The grantee agrees to take the necessary actions to maximize the benefits of this
grant project such as assuring the timely hookup of residences of the community for
vhich this project is providing collection severs.
10. The Grantee shall not permit any person [o discharge vastevater into say collection
line, lateral sever, interceptor or other means of conveying vastevater to the
facilities constructed under this project, if such vastevater originates from any
building, Facility or other manner of construction vhich is hereafter erected or
otherwise placed, in whole or in part, upon land vhich is defined as a wetland or
floodplain within the meaning of Federal Executive Orders 11988 and 11990.
11. The grantee agrees to build a complete waste treatment system as defined in
40 CF8 35.2005(b)(12) whether or not grant funding is available Eor the remaining
projects in the facility plan. The grantee shall submit to DOH an expansion and
financial plan for construction of the complete waste treatment system described in
the facility plan by October 31, 1990.

12. The grantee agrees that it will comply with the Federal Drug-Free Gorkplace Act of
1988 in accordance with 40 CFR Par[ 32. Under [he Act, all procurement contracts,
including purchase orders, awarded pursuant to the provisions of the Federal
Acquisition Regulation (FAR) [hat are to be performed in the United States are
subject to the Act. In addition, under the Act, all the contractors, grantees, and
federal assistance recipients Eor fiscal year beginning after Narch 18, 1989, are
required to certify that they will provide a drug-free workplace.

We are pleased to transmit Grant Amendment No. 1, Hilo
Wastewater Treatment and Conveyance Project, Phase I, as part of
our actions to resolve the Hilo Early Warning Audit.
This amendment revises the construction schedules in grant
condition no. 11, and adds grant conditions no. 13-19. These
grant conditions describe the necessary County action required to
fully utilize the Hilo Wastewater Treatment Plant (WWTP), and to
evaluate and update the County's user charge system/sewer use
ordinance. This amendment also expands the scope of the Hilo
grant to include the construction of the Kalanianaole Collector
and Ainako Interceptor Part B.
The enclosed amendment is an administrative amendment and
does not change the total eligible project cost and/or the grant
amount.
The original and two copies of the enclosed grant amendment

This amendment also revises grant condition no. 11 and adds special conditions

11. The grantee agrees to build a complete wastewater treatment
system as defined in 40 CFR 35.2005(b)(12) whether or not
grant funding is available for the remaining projects in the
facilities plan. As a minimum, the grantee agrees to build

The grantee shall timely submit any grant or loan
applications necessary to fund the above collectors. If the
grantee fails to meet the schedule in this grant condition,
DOH and EPA will withhold payments from the grantee.
Furthermore, an unjustified delay of twelve months or
greater will result in a reduction of EPA's share,
termination, or annulment of the grant.
13. After reviewing Audit Report No. E2aWP0-09-0249-0400043, EPA
concludes that the projected flows as shown in the 1989
Facility Plan, need to be reevaluated by March 31, 1992.
The grantee will submit a draft report by January 31, 1992
to the Hawaii Department of Health. The grantee will:
- Reevaluate the projected flows for the collectors
and interceptors in the defined service area for
the 5 mgd facility;
- Relate the projected flows to the construction and
hook-up schedule;
- Evaluate the actual and projected infiltration and
inflow entering the system; and
- Evaluate the number of dwelling units and dwelling
equivalents to be connected versus those excepted
by the sewer use ordinance.
14. The County shall enforce the sewer use ordinance and require
each and every existing dwelling or dwelling equivalent
within the defined service area (as defined in grant
condition no. 13) to connect to the collection system in
accordance with the following schedule:

- 50 percent shall be connected within one year
after completion of the construction contract or
the County's acceptance of the project from the
contractor, whichever is earlier.
- 70 percent within two years after completion of
the construction contract or the County's
acceptance of the project from the contractor,
whichever is earlier.
- 100 percent within five years after completion of
the construction contract or the County's
acceptance of the project from the contractor,
whichever is earlier.
The connection calculation shall be based on the County's
inventory of existing dwellings and dwelling equivalents as
of September 1989, but shall exclude any system that has
been formally excepted from the sewer use ordinance.
15. At the end of the one, two, and five year periods as stated
in grant condition no. 14, the County shall:
- Conduct surveys of the community and on-site
systems within the service area, as defined in
grant condition no. 13, which have not been
connected to the 'collection systems; and
- Submit a report to confirm the findings and
results of the surveys to the Cesspool Phaseout
Program.
The County shall coordinate with the Cesspool Phaseout
Program, Hawaii Department of Health, in conducting these
surveys. The surveys shall identify failing systems, detail
recommendations for exceptions, and confirm compliance with
the connection schedule in grant condition no. 14.
16. Beginning one year after initiation of operations, the
County shall submit a report every six months to the Hawaii
Department of Health which shows its progress in
implementing its sewer use ordinance and the correction of
its I/I problem. The report shall show the following:
- Number of new connections;
- Total possible connections given the formal
exemptions outlined in the sewer use ordinance;
- Current wastewater flow to the facility; and
- Current infiltration/inflow to the facility.

Should the County cannot implement its sewer use ordinance
as required in grant condition no. 14, then it should submit
a schedule of corrective action. Should the County fail to
meet the deadlines of the approved schedule of corrective
action, EPA will withhold payments or reduce the federal
share of the grant in proportion to the unused capacity of
the wastewater treatment plant. In addition, federal
funding is limited to the costs of a project with a design
capacity not to exceed 120 gpcd, including
infiltration/inflow. After review of the reevaluation, EPA
will adjust the federal share of the grant in proportion to
the utilization of the wastewater treatment plant.
17. The eligibility for grant participation in the funding of
this project is contingent upon a user charge system which
complies with 40 CFR 35.2140 and 35.2208. Failure to comply
with the aforementioned EPA regulations will result in
jeopardizing EPA grant participation.
The County shall submit the following to the Hawaii
Department of Health (DOH) for annual review:
a. A copy of the notification sent to the users which
indicates the user charge rate and that portion of
the charges and/or ad valorem taxes which is
earmarked for wastewater services.
b. A copy of the notification sent to owners of
property requiring connection to completed
collector sewers,
18. The County will conduct a user charge system study to
determine the monthly sewer fee required for the operation
and maintenance, and replacement (OM&R) costs of the
facility. In addition, the study shall address EPA's
comments as expressed in our letter to the Hawaii Department
of Health dated March 25, 1991, including:
- An evaluation of how the monthly sewer fee is
determined. To comply with EPA requirements, the
monthly service fees of a particular class should be
determined by distributing the OM&R costs for all
wastewater treatment plants (WWTPs) within the
grantee's jurisdiction in proportion to the use of the
WWTPs by the user class.

- An evaluation of the use of ad valorem taxes as a
dedicated source of revenue. The County must
demonstrate that the ad valorem tax identifies the
portion dedicated to OM&R costs and prove that the tax
has been in use since 1977.
- An evaluation of how users are annually notified of
user charge rates and whether the tax bill separately
states the portion of ad valorem taxes related to
wastewater treatment services.
- An evaluation of billing criteria.
19. The County will conduct the user charge system study and
implement study recommendations in accordance with the
following schedule:

EXECUTIVE SUMMARY
The purpose of this report is to respond to the Hilo Special Grants Conditions
which was amended as a result of a special review officially known as the Audit
Report No E2aWP0-09-0249-0400043. The special review made the following
conclusions claiming that the County of Hawaii were not in compliance with the
Construction Grants program:
1. The wastewater flow to the new treatment facility will not meet the
required minimum of 70% of the 5 mgd design flow that must be
generated by the existing and new service areas.
2. The wastewater flows from new service areas that are constructed
before 1997 will not generate enough wastewater to satisfy the 70%
of design flow requirement.
3. County's recently implemented sewer ordinance will not provide
enforcement necessary to require connections to the sewer system
because of too many exemptions allowed under the new ordinance.
These claims of non-compliance are a result of using the flow and construction
schedule from the 1989 Facilities Plan which are outdated, and of misinterpreting
the intent of the County's sewer ordinance. The general objectives of this report
are to re-evaluate and revise wastewater flow information, and clarify the language
contained in the sewer ordinance, or more specifically, this report will do the
following:
1. Compare revised total flows from existing and new service areas
with the minimum requirement of 70% of the 5 mgd design flow
capacity: Re-evaluate existing wastewater flows for 1991 by using
current water consumption data and re-evaluate existing and new
infiltration/inflow.

2. Relate the estimated total flows to the construction and sewer
connection schedule for the following new service areas;
a. Waiakea Houselot Collection Sewer
b. Old Waiakea Mill Sewers
c. Ainako Interceptor Part A
d. Kalanianaole Collection Sewer
e. Ainako Interceptor Part B
3. Evaluate the number of dwelling units to be connected versus those
exempted by the sewer use ordinance.
Based on the objectives and its results, this report concluded that:
1. The total ADWF, including the existing ADWF of 3.27 mgd, is 3.74
mgd. Based on this, the 3.74 mgd from existing and new service
areas will exceed the minimum requirement of 70% of the 5 mgd
design flow capacity. The water consumption data was used to
compute the existing ADWF of 3.27 mgd, or 116 gpcd. Existing dry
weather infiltrations were calculated by three methods. The "best"
estimate of these methods was 1.0 mgd.
• 2. Wastewater flows from the new construction would generate
enough wastewater to satisfy EPA's minimum requirement of 70% of
design flow capacity before 1997.
3. County's recently implemented sewer ordinance would provide
enforcement necessary to require connections to the sewer system.
