An Ordinance Amending Chapter 11, (Housing Code) of the Hawaii County Code by Adding Language To Section 11-6 To Provide Clazification for Determining the In-Lieu Fee. Transmitted for your consideration is a drafr 2 of Bill 17. This draft makes the following "housekeeping" changes to the bill: 1) Amends the title of the bill to refer to the current 2005 edition of the Hawaii County Code. This draft also amends the title by removing an unnecessary reference to ordinance OS-23. These non-substantive changes correct minor defects in the bill's title in order to bring it into conformance with our drafting standazds. They do not change the subject of the bill. 2) Reinserts the words "for" in subsection (c) ("for resort") and "units" in subsection (d) ("such as units offered for rent"). Punctuation, that appears to have been inadvertently removed from or added to the existing language of subsections 11-6(c) & (d) of the Hawaii County Code, is also restored or removed as appropriate. In addition, in subsection (c), amended "twenty five" to "twenty-five" (added a hyphen) and amended "one hundred twenty-percent" to "one hundred twenty percent" (deleted a hyphen) to conform with our drafting format. Uote _IAN 0 Hawaii County is an Equa[ Opportunity Provider and Employer Council Members January 3, 2007 Page 2 As amended to incorporate these corrections as well as the substantive amendments proposed by the bill, subsections (c) & (d) appear in draft 2 of the bill as follows: (Only changes from the existing language of the Code are ramseyered.) "(c) The in-lieu fee for each required affordable dwelling unit for resort, hotel, and industrial uses shall be twenty-five percent of: the median sales price for asingle-family home in the tax map zone containing the project, in the previous calendar year, minus the affordable price for households earning one hundred twenty[-]percent of the median. (d) The in-lieu fee for each completed dwelling unit not offered for sale (such as units offered for rent) shall be twenty-five percent of: the median sales price for asingle- family home in the tax map zone containing the project in the previous calendar year, minus the affordable price for households earning one hundred twenty percent of the median. The in-lieu fee shall be applied against all dwelling units not offered for sale." This revised draft has been reviewed and approved by staff of the Office of Housing and Community Development.
