Murashige Laura

From: blann [blann@verizon.netj

Sent: Monday, January 01, 2007 11:06 PM ;

To: counciltestimony@co.hawaii.hi.us

Subject: Resolution 21-07 'Ban the Big Box Store~~~ ~ F~ 3
't
Dear County Council, Cu t~~'
I would urge a speedy rejection of this doubtless w~~.lJt'~~la'nirig Y`@sdT'xtion for several
reasons:
1) The Council has serious business of the people in need of attention,
e.g.-
a)solid waste disposal for East Hi.
b)plans to solve police personnel shortages
c)plans to give communities more control over decisions affecting only those
communities
d)in passing a recent upzone on Hualalai Rd., Mr. Arakaki mentioned that council
should
not restrict development, but should improve the road. Several million$ now need to
be
made available to plan the widening, and probably the order of 50-100 million to do
the
widening.
e)Several roads projects need to be gotten back on track; if not done yet, outside
counsel
should be hired to expedite the several condemnation proceedings which have been
dragging on.
f)The inequity in voter registration and walk in voting due to the million$ annual
budget of the Kuhio
facility, with no program elsewhere in the county needs to be balanced.
2)The proposed resolution, how many sku's makes a Big Box store' should be postponed to
a later
time and debated along with how many angels can dance on the head of a pin'. It
opens a
Pandora's box which will only invite litigation. What a waste of council time. The
problem
could more subtly be solved in the zoning process of the individual application.
3)I have always heard the mantra that protectionism is a dead end street- and would
discourage council
from spending their valuable time trying to craft a resolution which is not too warm,
not too cold, but
'just right' for purposes of protectionism- which later after expensive litigation will
be ruled illegal.
4)If the box store is part of a national or international chain, would this constitute
'restraint of interstate
commerce'?
You can see that I think that this resolution is a terrific idea, but, with your time
being limited and with much important work to be done, I urge its speedily being laid to
rest.
Respectfully,
Marshall Blann
75-5865 Walua Rd. D423
Kailua-Kona, 96740
Comm. No.
Ref. To:P.n'~~ 9 ~nni
Ref. Uate~T
i
