Attached please find a copy of Resolution No. 402-06, Draft 4, adopted by our Council on August 1, 2006. You will note that eighth "Whereas" states that "...it is recognized that the ability to hold effective meetings and to comply with all statutory, legal and processing requirements will depend upon the provision of sufficient personnel, equipment and support services...". The final "Whereas" which amended Rule No. 2 of our Council Rules states, among other conditions, that "Videoconferencing shall be provided for all Committee and Council meetings held in West Hawai`i." I would like the Council to take some time during the upcoming Council meeting to discuss the status of vdeoconferencing, equipment and staffing of Committee and Council meetings in West Hawaii. WHEREAS, on December 6, 2004, Resolution No. 4-04, Rules of Procedure of the Council of the County of Hawaii governing the affairs of the Council, was adopted; and WHEREAS, to clarify and strengthen its organizafional structure, expand authority of Council Members for greater responsibility, accountability, empowerment and flexibility in its day-to-day operations, Resolution No. 99-OS was thereafter adopted; and WHEREAS, Rules of Procedure and Organization of the Council of the County of Hawaii, Rule No. 2, Meetings, sets forth the various kinds of meetings the council may hold, outlines scheduling requirements and provides public notice guidelines; and WHEREAS, Rule No. 2, paragraph 1, Regular Meetings, provides, among other things, that the Council shall meet at least quarterly in the judicial districts of North Kona or South Kona; and WHEREAS, due to rapid growth and development occurring in West Hawaii and resulting impacts upon the quality of life, citizens residing in the districts of Ka`u, South Kona, North Kona, Waikoloa, Kohala and Waimea, have expressed a strong desire for increased constituent participation, citizen involvement and commitment to the democratic processes of county council meetings; and WHEREAS, public opinion reminds us that effective debate, resulting in positive decision-making, requires personal interaction among decision-makers and citizenry who will ultimately be impacted by such decisions; and WHEREAS, an equal amount of county council meetings between East and West Hawaii will ensure all citizens fair and equitable access to government by Democracy and allows fair opportunity for public input, participation, discussion, debate and resolution of issues that impact quality of life; and WHEREAS, it is recognized that the ability to hold effective meetings and to comply with all statutory, legal and processing requirements will depend upon the provision of sufficient personnel, equipment, and support services; and WHEREAS, the council wishes to amend its rules by amending Rule No. 2, paragraph I, relating to Regulaz Meetings, to read as follows: RULE NO. 2 MEETINGS "1. Regular Meetings. Except as otherwise provided, the Council shall meet regulazly at least twice in every month begitming at 9:00 A.M. in the Council Meeting Room at the County building, Hilo, Hawaii, on the first and third Wednesday of each month, or at other places and/or times designated by the Council^[;-pr~svded-fl}at~he + a ' ~ ae~~~--~•-a Provided however. that effective January 1 2007 the county council shall hold an equal nttmber of Committee and Council meetings in East Hawaii and in West Hawaii subiect to the council's aronroval of adeouate personnel equipment and suproort services to comroly with statutory, legal and processing deadlines This meeting schedule shall remain in effect at least through the 2007 calendar veaz This schedule may be subiect to review in December 2007, at the discretion of the Council Videoconferencing shall be provided for all Committee and Council meetings held in West Hawaii. Notwithstanding Section 3-7, Hawaii County Charter, the second regular meeting of the Council may be in a location other than Hilo." NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that amendment to Rule 2, paragraph I, relating to Regular Meetings, is hereby adopted. 2 BE IT FINALLY RESOLVED, that the County Clerk may reprint the Rules of Procedure and Organization, Rule No. 2, without the brackets, bracketed material, and underscoring.
