<br /> Testimony against Bi11345-City 8c County Hawaii County Council Meeting January 4, <br /> <br /> 2007 <br /> I am against Bi11345 which amends the definition of "family" to include a group of not <br /> more that eight unrelated persons, plus staff living in a licensed facility or certified by the <br /> State Department of Health. <br /> The word "family" according to accepted usage and the Webster Dictionary means <br /> related persons or persons of a common lineage. When we refer to "family" as unrelated <br /> persons aze we saying that a family of birds nesting includes a dove, mynah, parakeet, <br /> owl and hawk. <br /> My second point has to do with our rights as citizens living in the community, in our case <br /> a residential association, losing our power to determine our own destiny. <br /> I lived on Oahu for 45 years in condominiums projects as I could not afford to purchase a <br /> single famiiy home. All of the condo have restrictive convents known as CC&R <br /> (Condition, Covenants & Restrictions} The CCBcR was very effective in providing for a <br /> safe, comfortable and pleasant living environment as the owners association was <br /> empowered to enforce the CC&R against owners/tenants violating the restrictive <br /> convents. <br /> My wife and I, seven years ago, contemplating retirement decided to return to our birth <br /> place on the Big Island. We purchase a vacant lot in the Keaau Ag Lots due to this <br /> project had an established Owners Association with CC&R We grew up in the <br /> Plantation Camp environment with single men and related families, The Camps proved to <br /> be a place which we lived in harmony, safety and trust with all ethnic groups. <br /> I recommend that the City Council-City & County of Hawaii enact slaw/ordinance that <br /> Owners Associations/Neighborhoods be given the right to approve or deny any <br /> Application to the State of Hawaii Department of Health for any Care Facility in their <br /> effected area. <br /> In closing I ask the City Council to give us taXpaying, voters living on the Island of <br /> Hawaii our basic rights to life, liberty and the pursuit of happiness. <br /> Submitted By: <br /> Hiroshi Kozohara <br /> P.O.
