1. Can you explain the relationship between your husband s business, ;county councu
Kiyosaki Tractor WorKS, and your position as the Chief Engineer
regarding contracts that Kiyosaki Tractor Works has with the Department
of Public Works ?
2. Are you concerned tl-~at this may be a conflict of interest where you are a
direct beneficiary of income received from your husband's contracts with
Public Works and at the same time are charged with administering the
contract ?
3. Who signs the contracts between the Department of Public Works and
Kiyosaki Tractor Works ?
Is your deputy, Jiro Sumada, a licensed Civil Engineer ? If not, can you
explain how an unlicensed person can sign a contract on behalf of the
Chief Engineer, who is mandated to have a license to practic:e
engineering in the State of Hawaii ?
5. Does your deputy sign contracts, documents, plans or letters on your
behalf that should be signed by a licensed engineer ? Are ycu concerned
that there may be a misrepresentation of the Office of the Chief Engineer
by having an unquali~ied person represent you ? Are you concerned that
the action of your deputy signing documents may make these documents
invalid ?
6. Being an unlicensed person, what exactly does your deputy do ? Are yo•~~
concerned that there is a perception that one of the deputy's jobs is to
look out for the best interests of your husband's or Willocks Gonstruction
Company where he came from ?
7. Does your deputy supervise licensed Civil Engineers within the
department ? Is he in the position to over rule any of the licensed
engineers professional decisions ? If so, aren't you concerned that your
deputy may be practicing engineering without a license, that is a violation
of state law ?

8. When your husband signs aNon-Gratuity Affida~~~it for a Public Works
contract, isn't he atte:;ting that no county official is benefiting from that
contract ? How can t~7is be if you are the appointed Chief Engineer in
charge of Public Works contracts ?
9. Have you, as the Chief Engineer, ever solicited r,vork for your husbands
company with a contractor that was doing contract work for the County or
other government agency ?
10. What about the Alenaio Stream Improvement project in downtown Hilo
with the NOVA Company ? Wasn't your husband's company a
subcontractor on that job ? Did his involvement with the project res~ iLt in
less interterence frorr~ the County to ensure compliance with the
specifications ?
11.Have you ever signed a subdivision or other development plan that was
partly in the flood zone and had been placed on "hold" by previous Chief
Engineers because of the flooding problems ?
12.What about the Waiwai Subdivision in upper Waiakea ? Who was the
contractor ? Was your husband a subcontractor or did he deliver any
material on that job ?
13.What about the Brilhante Subdivision across from the Waiakea-Uka
gym? Who was the contractor on that job ? Was your husband a
subcontractor or did Ise ever deliver material for that job ?
14.What has been the repercussions of the Waiakea Flood of August 199?
How many damage claims have been filed and settled against the
County of damage tc property in known flood areas ? Are you concerned
that continued appro~ial of development in flood zones, places property
and individuals in danger ?
15.Explain how after the flood of 1994, your husbands company got a
majority of the non-bid equipment rental work ?

16.On contracts that your husband has had with the County of Hawaii, that
was administered by your department, did he exert influence with those
County employees to bend the specifications and rules to favor his
operations or the way he operates ? Does his comments regarding those
employees that do not see things his way, have a bearing on their
performance ratings ?
17.On contracts that your husband currently has with the Count~~ of Hawaii,
that is now administered by your department, does he exert influence
with those County employees to bend the specifications and rules to
favor his operations cr the way he operates ? Does his comm-ants
regarding those employees that do not see things his way, h~~ve d
bearing on their perfcrmance ratings ?
18.How many employees are in the Department of Public Works ? What is
your projected budget for FY 97-98 ?
19.How many employees are in each division of Public Works and what are
their projected budgets for FY 97-98 ?
20.What large projects do you anticipate in FY 97-98 ? How are these
projects to be funded ?
21.Are you receiving an allowance from the County for your vehicle ? How
much is that car allowance ? What County business do you undertake
with your car to justify the allowance ?
22.For time spent during normal working hours, doing other than County
business such as personal things, do you write off this work time as
vacation ?
