Comm. 436: AN ORDINANCE AMENDING CHAPTER 20, OF THE HAWAII COUNTY (Bill 151) CODE 1983 (2005 EDITION) RELATING TO LITTERING AND REFUSE (2004-2006) DISPOSAL (adds that each day of violation for littering shall constitute a separate offense; and imposes a penalty of not less than $250 and not more than $1,000 for illegal dumping. and each day of violation shall constitute a separate offense.) From Councilmember Bob Jacobson, dated August 31, 2005, transmitting the above bill, which seeks to strengthen enforcement of illegal dumping by facilitating realistic enforcement. (Draft 2) (2004-2006) Draft 2 changes the penalties for littering by removing the option of community service; and changes the penalties for illegal refuse disposal by 1) increasing the maximum fine to $1,000 for each violation; 2) adding imprisonment, with a sentence of up to 30 days for each violation; 3) adding a sentence of both fine and imprisonment; and 4) removing the option of community service.
