HomeMy WebLinkAboutRES 037 Draft 01 2006-2008 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 3'7 ' l~ RESOLUTION GRANTING THE ABANDONMENT AND SALE OF REMNANTS AT AHUALOA HOMESTEADS, AHUALOA, DISTRICT OF HAMAKUA, COUNTY AND STATE OF HAWAII, BEING PORTIONS OF TAX MAP KEY: (3)4-6-009:008 AND KAHANA DRNE. WHEREAS, the County of Hawaii is the owner of Lot A, containing an area of 454 squaze feet, identified as being a portion of Tax Map Key: (3)4-6-009:008 (see attached); and WHEREAS, the County of Hawaii is the owner of Lot R-1, containing an area of 9,892 squaze feet, being a portion of the paper alignment of Kahana Drive (see attached); and WHEREAS, Lot R-1 is not utilized as a roadway because of the current realignment of Kahana Drive; and WHEREAS, the County of Hawaii finds that Lot R-1 is no longer required as a vehicular transportation corridor; and WHEREAS, the current alignment leaves Lot A as a remnant parcel as well; and WHEREAS, the County of Hawaii finds that Lot A and Lot R-1 are economically and physically unsuitable or undesirable for development or utilization as sepazate units by reason of their location, size and shape, and by definition are remnants in accordance with Section 2-110, Hawaii County Code; and WHEREAS, Peter A. Helmick and Sandra J. Helmick, are the owners of adjoining Lot 4, Tax Map Key: (3)4-6-009:094, and have expressed a desire to acquire Lot A and Lot R-1; and WHEREAS, all roadways, once established, continue until vacated, closed, abandoned or discontinued by resolution of the Council; and WHEREAS, Sections 2-111 and 2-118 of the Hawaii County Code authorizes the disposal of road remnants by offer of sale to the abutting owner. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that Lot A, containing an azea of 454 square feet, and Lot R-1, containing an area of 9,892 square feet, aze hereby abandoned and discontinued as County rights-of--way which are physically and economically unsuitable or undesirable for development or utilization as separate units by reason of their location, size and shape and by definition are remnants in accordance with Section 2-110, Hawaii County Code; and BE IT FURTHER RESOLVED that the Finance Director is authorized to sell the aforementioned remnants in a manner consistent with Section 2-118, Hawaii County Code, to the adjoining property owners, Peter A. Helmick and Sandra J. Helmick. BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii is directed to transmit copies of this resolution to: (1) Mayor Harry Kim; (2) Finance Director William Takaba; (3) Assistant Corporation Counsel Gerald Takase; and (4) Peter A.
