RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF THE ATTORNEY GENERAL, PURSUANT TO HRS 46-7, FOR A STATEWIDE SEXUAL ASSAULT TRAINING GRANT WHEREAS, the State of Hawaii Department of the Attorney General's Crime Prevention & Justice Assistance Division has authorized funding to the Hawaii Office of the Prosecuting Attorney to coordinate a Statewide Sexual Assault Training Program; and WHEREAS, these funds, derived from the FY 2005 Justice Assistance Grant, will be used to coordinate a statewide training conference aimed at improving the delivery of sexual assault services within the criminal justice system; and WHEREAS, this conference, to be attended by police, prosecutors, medical/forensic examiners and victim advocates, will increase the skill level from arrest and investigation, medical/forensic response, victim advocacy, to prosecution; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, an agreement with the State of Hawaii Department of the Attorney General, to enable the County to coordinate a Statewide Sexual Assault Training Program, as described in the proposal to the Department of the Attorney General, attached hereto and incorporated herein by reference as Exhibit "A". BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Office of the Prosecuting Attorney, and the Finance Department. Topics will be pertinent to these various disciplines and to the crime of sexual assault. The three-day training will include a plenary speaker, multidisciplinary case reviews, breakout sessions, and a mock trial using conference participants and presenters. The intent is to work on skills within disciplines and within the service delivery systems, with the ultimate goal of improving sexual assault arrests, investigations, prosecutions, and victim services statewide. Specialized training for-prosecution-will also focus-on-court proceedings-and trial case reviews-that integrate the services of law enforcement and advocacy providers to strengthen prosecution approaches. Budget: Consultant ($14,950), transportation and subsistence ($14,400), other costs ($16,650). Match of $11,500 from State Asset Forfeiture funds. Match funded items aze not identified. HiPros~s currently using Byrne F~2003 funds ($38,850) that will run through 09/30/2006. The project has run for 10 months. RECOMi\'IEND FUNDING: The proposal is for the 3rd Statewide Sexual Assault Multi- disciplinary Conference and it will be the second time the Hawaii County Office of the Prosecuting Attorney is coordinating the event. The last event was held in Keauhou, Kona in June 2006. Police, prosecutors and the professionals in related agencies reported that they gained new skills and knowledge and will integrate this into their work. It is recommended that the Project establish a Planning Group that represents the various professional disciplines involved to identify the relevant workforce skills and knowledge that participants may gain from the training. The workshops can be "tracked" from basic to advanced levels. Participants attending the conference should be able to take the skills and information ]earned and apply them to their daily work activities. An agenda should be provided to the Department of the Attorney General for preliminary review and comments. The project will need twelve (12) months ofFY2005JAGfunding at 534,500. EXHIBIT °°A"
