In 1978, the County of Hawaii had obtained a license from the Richardson Trust, the owners of the property at that time, for a fee of $500/year or 10 percent of their property taxes to create a temporary ponding site (across the Hilo Police Station) for runoff generated by the State Mohouli Housing Project. The Department of Public Works intended to divert these flows to Alenaio Stream via a new underground drainage system as part of the Kukuau Street Improvement project; however, this project was abandoned during the mid-80s. The current property owners have not been able to utilize their property due to the pond created by the County/State of Hawaii and would like to be properly compensated for their loss. An economic analysis indicates that it would be more cost effective to acquire the properties to maintain the ponding area rather than to install a new drainage system. Comm. 47: A RESOLUTION TRANSFERRING/APPROPRIATING AN APPROPRIATION (Res. 26-07) OUT AND FROM THE DESIGNATED FUND ACCOUNT(S) AND CREDITING SAME TO A DESIGNATED FUND ACCOUNT(S) (transfers $10,000 from the Clerk-Council Services Contingency Relief account and credits same to the Kona Prosecuting Attorney Office account for the Kahua Na`au A`o's Shiro-Taka Kenpo Karate School of Self-Development) From Councilmember K. Angel Pilago, dated December 14, 2006, transmitting the above resolution. These discretionary funds from Council District 8 will be used for the Kahua Na`au A`o's Shiro-Taka Kenpo Karate School of Self-Development, whose focus is to provide at-risk youths in the community with substance abuse education and prevention through self-defense discipline training and exercise techniques integrating social, cultural and family values. Comm. 52: AMENDMENTS TO THE HAWAII COUNTY CODE FINANCIAL DISCLOSURE REQUIREMENTS From Bobby Jean Leithead-Todd, Deputy Corporation Counsel for Board of Ethics Chair Bob Williams, dated December 27, 2006, requesting the Council draft an amendment to Hawaii county Code Chapter 2, Administration, Section 2-91.1 (c) relating to Financial Disclosures. The amendments include i) Deleting the reference to property held within the County in §2-91.1(c)(5) in order to illicit information about property held outside the county, state or country; and changing dollar amounts in §2-91.1(c)(8)to reflect the increases in property values that have occurred over the past few years. Comm. 61: REPORT ON COUNTY OF HAWAII COMMUNITY FACILITIES DISTRICT NO 2006-1 (THE VILLAGES OF AINA LEA) From Public Works Director Bruce McClure, dated December 28, 2006, transmitting the above Report pursuant to Res. 486-06. The Study and Report was conducted and prepared by David Taussig & Associates, Inc., consultants to the County; and is in accordance with Section 32-21 of the Hawaii County Code. FC-3 Page 3 January 18, 2007 Comm. 62: RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF LATER FISCAL (Res. 28-07) YEAR AND OF MORE THAN ONE FISCAL YEAR FOR POSTAGE METERS AND SCALES (for amulti-year lease agreements for two years for a postage meter and scale for the Office of the Corporation Counsel, Family Support Division's [Hilo and Kona offices]) From Finance Director William Takaba, dated December 28, 2006, transmitting the above resolution. The current lease on their postage meters and scales will be expiring soon. Comm. 63: A BILL FOR AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 42, HAWAII (Bill 19) COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO THE PUBLIC ACCESS, OPEN SPACE, AND NATURAL RESOURCES PRESERVATION FUND (sets forth the process to set aside two percent of property taxes in the Open Space Fund to coincide with the dates of property tax collection twice yer year) From Councilmember Brenda Ford, dated January 2, 2007, transmitting the above bill. The second half of taxes is due as of February 20, 2007. Since the 2 percent Ballot Initiative became law as of November 8, 2006, the 2 percent of property taxes be set aside as the second half of 2006 taxes are received and then prorated for the time from November 8 to the end of the calendar year, 2006. The bill also includes a provision to set aside the monies contained in the Opens Space Fund in a conservative interest bearing account. Cites specific language included in the proposed ordinance. Comm. 73: RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE MONETARY (Res. 33-07) CONTRIBUTION FROM THE CONTINENTAL PACIFIC, LLC FOR THE KULAIMANO PARK EXPANSION; and (Bi1121) AN ORDINANCE AMENDING ORDINANCE NO. 06-80, AS AMENDED, RELATING TO PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR JULY 1, 2006 TO JUNE 30, 2007 (adds the Parks and Recreation, Kulaimano Park Expansion Project for $330,000) From Finance Director William Takaba, dated January 3, 2007, transmitting the above resolution and bill. Continental Pacific, LLC has committed to contribute to the County of Hawaii, the sum of $15,000 from each sale of the 22 lots known as the Pepeekeo North SMA (Special Management Area) and Pepeekeo South SMA lots at Pepeekeo Point. Their expected contribution, totaling up to $330,000 will be used for the specific purpose of the design and construction of improvements at the Kulaimano Center and Park. At this time $30,000 has already been received by the County of Hawaii due to the sale of two lots. FC-3 Page 4 January 18, 2007 Comm. 74: AN ORDINANCE AMENDING ORDINANCE NO. 06-80, AS AMENDED, (Bill 22) RELATING TO PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR JULY 1, 2006 TO JUNE 30, 2007 (by adding the Environmental Management East Hawaii Reload Facility yroiect for $2 million) From Finance Director William Takaba, dated January 3, 2007, transmitting the above bill. The design and construction of the basic elements of a solid waste collection and processing complex (reload building and related infrastructure) allow for interim and long-term options for legal and effective management of solid waste. For the interim option of bale and barge, as well as for increasing the life of the Hilo Landfill, a tipping floor and the related infrastructure is required. This appropriation, which brings the total appropriation for this project to $9.32 million, covers an anticipated funding shortfall. This project allows for the construction of the reload building, scale trailer, scales, utilities, and roadways in the area of the existing Hilo Solid Waste Transfer Station. Environmental Management is confident that this facility will provide the flexibility of function that the County needs to handle our island's solid waste well into the future.
