The following pages make up a nunber of reasons why Plan to Protect, the
Kona non-profit organization, stands in opposition to the adoption of Bills
371, 372 and 372 (draft 2).

In our review of Bills 371, 372 and 373, we can find no language
which limits this facility to use by golf club members. As the
Bills now stand, within the current density standards imposed on
a Resort/Retreat, this facility could be developed as a public,
commercial resort. People in this Community are opposed to any
possibility of that occurring. Language in these Bills must include
legally enforceable conditions which restrict the use of this
facility to club members-only, as the developer has represented
to us. The language must be specific enough to prohibit people
from using the facility by paying a twenty-four hour membership
fee, thereby getting around the restrictions placed on membership-
only facilities.

Also. the construction of [Construct] the Mamalahoa Highway Bypass in its
entirety between the approximate vicinity of Keauhou and Captain Cook,
consisting of two lanes with sufficient right-of--way for a total of [our] f4uI lanes,
provided further, that the section of the Mamalahoa Highway Bypass between
Keauhou and HalekPi Street shall be completed and available for public use prior
to the isc_uance of a certificate of occupancy of the [lodge] nosed develop
within the [entire project azea] subjg~t area.
Conspicuously absent is the language from the Bills which were passed
granting Oceanside 1250 their rezoning. In two previous Bills the
following language was required: "If, before completion and opening
of the entire Mamalahoa Highway Bypass, a portion of said bypass
is completed and opened, and said portion provides a connection
to Haleki'i Street, a barricade or breakaway gate, meeting with
the requirements of the Department of Public Works, shall be
installed by the applicant as part of the Haleki'i Street
improvements."
The reason this language was required is as follows: It was
determined that Haleki'i Street is a sub-standard road which is
in violation of County Codes. The Codes restrict the grade of
vehicular thoroughfares to 12~. Exceptions may be granted by the
County Engineer up to 158. But portions of Haleki'i Street are
18~ grade. County Code also limits intersections such as the one
at Haleki'i Street and Mamalahoa Highway to 5~. The current grade
is at least double. The County also considers it impudent for a
residential road, with closely spaced drive ways to be used for
a vehicular thoroughfare.
Accordingly, the above clause must be included in Bill 373
prior to consideration on the part of the Council, especially in
light of the fact that the lodge will now be developed prior to
the occupancy of home sites-

condition is to prevent the use of Haleki'i Stteet as a vehicular thoroughfare
between the existing Mamalahoa Highway and a-F~ [the Phase 1 section
]of the Mamalahoa Highway Bypass until the satire proposed Mamalahoa
Hiehwav Bypass between the approximate vicinity of Keauho ~ nd .antain
Cook has been completed and opened for general public use; and
l~[(6)] provide roadway stub-outs, generally shown in Exhibit •B', to provide future
connections between the subject property, [the Alii Highway, and southern
extensions there from;] and the a ' centprotxrties to the north and south:
provided that such stub-outs shall be constructed in accordance with the
construction phasing as approved by the Department of Public Works.

Transportation-Highways Division Standards for a regional arterial bypass highway or

BIG ISLAND MAYOR SEEKS CURBS ON URBAN SPRAWL
This story appeared in the December 2nd addition of the Honolulu
Advertiser. What does it mean? First of all, has anyone thought
about what "URBANIZE" means? Here is a definition that appeared
in an article published by the American Planning Assoc.
TO URBANIZE: Any residential or commercial development that results
in people traveling to and from previously inaccessible land.
I challenge any one to deny that the Oceanside 1250 project,
with its proposed 800 home sites and a lodge will not open the flood
gate to Urban Sprawl in South Kona! The Mayor is pushing for the
K to K Plan. The Keahole to Kailua proposal is designed to establish
urban growth boundaries for Kona. What, in heavens name, is the
purpose of establishing urban Growth Boundaries, if this type of
speculative development is encouraged outside of those boundaries!
We feel that people who stand to gain from any development,
planned or unplanned, don't care about the damage Urban Sprawl will
have on our Community.
People in South Kona don't want this project. It is a
speculative dinosaur left over from when Japanese investment was
buying up everything in sight. And what good had that done us?!
