SUBJECT: Sill 345 - Amending Chapter 25, Article 1,
Subsection 25-1-5 (b), (Zoning Code)
As requested, the Office of Housing and Community Development (OHCD) is
providing the following for information for Bill 345 which is scheduled for
today's Council meeting.
As an advocate for Fair Housing and related mandates the OHCD feels that these
issues should be considered. Legal exposure by the County passing or not
passing Bill 345 should be discussed with the Office of the Corporation
Counsel.
For example:
Title II of the Americans with Disabilities Act (ADA) imposes an
affirmative duty on local governments to make reasonable accommodation (by
modification or exception) in land use regulations and practices when such
accommodation may be necessary to afford disabled persons an equal opportunity
to housing.
Title II, Part A of the Americans with Disabilities Act specifically
prohibits state and local governments, their departments, agencies and any
subdivision from excluding qualified individuals with disabilities from any
services, programs or activities offered.
In general, the OHCD would support the opportunity to produce more housing
units, including special needs housing.
