This draft amends Resolution 29- 07 which was discussed and passed through the Environmental Management Committee on January 23, 2007. Resolution 29-07 will be discussed at the next Council meeting at which time I will be asking to amend Resolution 29-07 with Resolution 29-07 Draft 2 with the amendments listed below: 1. The title of the resolution has been amended to read as follows: RESOLUTION REQUESTING THAT THE DEPARTMENT OF ENVII20NMENTAL MANAGEMENT DRAFT AN ORDINANCE REQUIItING MANDATORY GLASS CONTAINER RECYCLING BY RESTAURANTS AND BARS 2. The NOW, THEREFORE, BE IT RESOLVED pazagraph has been amended to read as follows: NOW, TIEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that ]the Department of Environmental Mana eg ment will draft an ordinance requiring mandatory glass container rec} cling by restaurants and bars. 3. The BE IT FURTHER RESOLVED paragraph has been amended to read as follows: BE IT FURTHER RESOLVED that any [mandate] ordinance shall be timed to allow restaurants and bars sufficient time to make accommodations for the implementation of mandatory glass container recycling, but no later than 12 months from the effective date of an amendment to the Hawaii County Code requiring [sash] mandatory glass container recycling by restaurants and bazs. BJ/bl District 6 -Upper Puna Ka'k, and South Kono Hawaii County Is An Equal Opportunity Provider And Employer COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 29-07 Draft 2 (Proposed ) RESOLUTION REQUESTING THAT THE DEPARTMENT OF ENVHtONMENTAL MANAGEMENT DRAFT AN ORDINANCE REQUIRING MANDATORY GLASS CONTAINER RECYCLING BY RESTAURANTS AND BARS WHEREAS, the Update to the Integrated Solid Waste Management Plan for the County of Hawaii adopted by Resolution No. 238-02, Draft 5 on November 20, 2002, identified island- wide diversion of solid waste from landfills by source reduction, reuse, and recycling as a major objective; and WHEREAS, on January 23, 2003, the County Council adopted Resolution No. 28-03, Draft 2, which further set forth goals and policies to divert 50% of solid waste from any landfill by 2008, and 80% of solid waste that would otherwise go to any landfill by 2013; and WHEREAS, landfills have a finite capacity and permitted air space, with the South Hilo Landfill projected to reach its maximum capacity in no more than two to four years, and the Pu`uanahulu Landfill reaching capacity at some point in the future upon exhaustion of permitted air space; and WHEREAS, landfills aze expensive to maintain in order to comply with strict Federal Environmental Protection Agency and State Department of Health requirements while in service and during post-service monitoring for a minimum of 30 years after closure; and WHEREAS, a new South Hilo Landfill would be difficult and expensive to construct and maintain, and siting of any solid waste disposal facility has proven to be controversial and time-consuming; and WHEREAS, by diverting reusable materials out of the waste stream, recycling prolongs the life of landfills; and WHEREAS, glass containers aze relatively easy to collect, process, and reuse; and WHEREAS, many restaurants and bazs generate significant quantities of waste items, particularly glass containers; and WHEREAS, currently, most, if not all, recyclable glass is used on-island, generally for aggregate and pipe-cushioning. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Department of Environmental Management will draft an ordinance requiring mandatory glass container recycling by restaurants and bars. BE IT FURTHER RESOLVED that any ordinance shall be timed to allow restaurants and bazs sufficient time to make necessary accommodations for the implementation of mandatory glass container recycling, but no later than 12 months from the effective date of an amendment to the Hawaii County Code requiring mandatory glass container recycling by restaurants and bazs. BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to the Department of Environmental Management for drafring of an ordinance and the proposed amendment to the Hawaii County Code requiring mandatory glass container recycling by restaurants and bars.
