RE: Proposed amendment to Bill 151 Draft 2
Attached for your review and consideration is Bill 151 Draft 3. Bill 151 Draft 2 will be discussed at the
next Council meeting at which time I will be asking to amend Draft 2 with Draft 3. After meeting with
Department of Environmental Management Director Bazbaza Bell and Hawaii County Deputy Prosecutor
Mitch Roth, I feel the following amendments to Bill 151 Draft 2 aze necessazy:
1. Section 20-8. Penalty; the first pazagraph of subsection (a), has been amended to include the option of
community service to read as follows:
(a) Any person who violates the provisions of this article shall, upon conviction, be sentenced to
pay a fine [ ' ~ Q""^ of not more than $1,000 and/or not more than 200 hours of
community service or both for each offense [ ;
2. Section 20-45. Penalty; subsection has been amended by deleting the defmition for petty
misdemeanor to read as follows:
