Attached for your review is a copy of how Resolution 29-07 will read if the proposed amendments are approved
The proposed amendments are listed below.
1. The title is amended to reflect my desire to have our Legislative Research Branch assist the Department of
Environmental Management and shall read as follows:
RESOLUTION REQUESTING THAT THE LEGISLATIVE RESEARCH BRANCH WORK WITH
THE DEPARTMENT OF ENVHiONMENTAL MANAGEMENT TO DRAFT AN ORDINANCE
REQUIRING MANDATORY GLASS CONTAINER RECYCLING BY RESTAURANTS AND BARS
2. The "NOW, THEREFORE..." clause, is amended to read as follows:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
the Legislative Reseazch Branch work with the Department of Environmental management [~vll] to draft an
ordinance requiring mandatory glass container recycling by restaurants and bazs.
3. The "BE IT FINALLY RESOLVED" clause is amended to read as follows:
BE IT FINALLY RESOLVED that the county Clerk shall forward a copy of this resolution to the Le islative
Reseazch Branch and the Department of Environmental Management for drafting of an ordinance and the
proposed amendment to the Hawaii County Code requiring mandatory glass container recycling by restaurants
and bars.

RESOLUTION NO. 29-07
RESOLUTION REQUESTING THAT THE LEGISLATIVE RESEARCH BRANCH
WORK WITH THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT TO
DRAFT AN ORDINANCE REQUIRING MANDATORY GLASS CONTAINER
RECYCLING BY RESTAURANTS AND BARS
WHEREAS, the Update to the Integrated Solid Waste Management Plan for the County
of Hawaii adopted by Resolution No. 238-02, Draft 5 on November 20, 2002, identified island-
wide diversion of solid waste from landfills by source reduction, reuse, and recycling as a major
objective; and
WHEREAS, on January 23, 2003, the County Council adopted Resolution No. 28-03,
Draft 2, which further set forth goa?s and policies to divert 50% of solid waste from any landfill
by 2008, and 80% of solid waste that would otherwise go to any landfill by 2013; and
WHEREAS, landfills have a finite capacity and permitted air space, with the South Hilo
Landfill projected to reach its maximum capacity in no more than two to four yeazs, and the
Pu`uanahulu Landfill reaching capacity at some point in the future upon exhaustion of permitted
air space; and
WHEREAS, landfills are expensive to maintain in order to comply with strict Federal
Environmental Protection Agency and State Departrnent of Health requirements while in service
and during post-service monitoring for a minimum of 30 years after closure; and
WHEREAS, a new South Hilo Landfill would be difficult and expensive to construct
and maintain, and siting of any solid waste disposal facility has proven to be controversial and
time-consuming; and
WHEREAS, by diverting reusable materials out of the waste stream, recycling prolongs
the life of landfills; and
WHEREAS, glass containers aze relatively easy to collect, process, and reuse; and
WHEREAS, many restaurants and bars generate significant quantities of waste items,
particularly glass containers; and
WHEREAS, currently, most, if not all, recyclable glass is used on-island, generally for
aggregate and pipe-cushioning; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Legislative Reseazch Branch work with the Department of Environmental Management [will] to
draft an ordinance requiring mandatory glass container recycling by restaurants and bars.
BE IT FURTHER RESOLVED that any ordinance shall be timed to allow restaurants
and bazs sufficient time to make necessazy accommodations for the implementation of
mandatory glass container recycling, but no later than 12 months from the effective date of an
amendment to the Hawaii County Code requiring mandatory glass container recycling by
restaurants and bars.
BE IT FINALLY RESOLVED that the County Clerk shall forwazd a copy of this
resolution to the Legislative Research Branch and the Department of Environmental
Management for drafting of an ordinance and the proposed amendment to the Hawaii County
Code requiring mandatory glass container recycling by restaurants and bars.
