The Commission concurs with the following as recommended by the Planning Director. The Planning Director has reviewed Bi11326 and agrees that a new University District is warranted. The Director, however, is recommending the following changes to the bill: Permitted uses: Addition of other uses (student health clinics, university credit union, post office, fraternity and sorority houses and student and employee apartments and houses). • Height limit: Specifies an overall height limit of 60 feet, regardless of location. • Minimum building site area: 10 acres, except that the minimum lot size of a leased lot maybe 7,500 square feet. • Minimum yards: Front and rear - 20 feet; side - 10 feet. • Other regulations: A maximum of 20 percent of a University District's land area may be in commercial use. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose and intent. In addition to educational functions, such as ]earning and research programs and facilities, university and college campuses generally include a variety and mix of other uses which serve the university or college community and which enhance the overall educational experience provided by a university or college. As such, university and college campuses should be treated distinctly from other zoning districts. Universities and colleges are valuable educational and research resources of the County of Hawaii, and present provisions for zoning limit their ability to provide a complete and conducive campus environment and sense of community on campus. The establishment of a "University" special district will provide Beater flexibility in establishing a mix of uses which are intended to enhance the campus environment of a university or college. SECTION 2. Section 25-1-5, "Definitions," Hawaii County Code 1983 (2005 Edition, as amended), is amended by adding a new definition to be appropriately inserted and to read as follows: "University" means anationally-accredited institution of higher learning, whether classified as a "university" or a "college" and whether public or private, including community colleges, providing facilities for teaching, research and group learning and authorized to grant academic degrees. SECTION 3. Chapter 25, Article 7, "Special District Regulations," Hawaii County Code 1983 (2005 Edition, as amended), is amended by adding a new division to be appropriately designated and to read as follows: Division UNV, University District. Section Purpose and applicability. The UNV (University) District shall apply to azeas of land that are utilized for campus-related activities and is intended to apply to azeas for the location and expansion of universities and the uses and facilities that are associated with and are supportive of them. Special consideration of such uses and facilities is appropriate given the unique chazacteristics of university areas, the variety of uses needed to serve the university community, and the vazying intensity of land uses in such a community. Section Designation of UNV districts. Each UNV (University) district shall be designated by the symbol "UNV." Section Permitted uses. (a) University facilities including classrooms, laboratory and reseazch facilities, administration facilities, athletic centers and facilities, auditoriums, student centers, libraries, museums, exhibition halls, cafeterias, (der~riteaes;l student health clinics, maintenance facilities and parking lots. (b) Limited retail and service establishments primarily intended to serve the specific needs of the student population of a university and aze normally associated with higher education institutions, including, but not limited to, retail stores whose primary customers are students or faculty of a university, convenience stores, theaters, restaurants, recreational and amusement facilities, taverns, drug stores, book stores, health clubs, news stands, photocopying, office supplies, word processing or typing services, computer sales and service, laundries, university credit union, financial institutions, post office and video rentals. RELATING TO A UNIVERSTTY DISTRICT BACKGROUND On September 20, 2006, the Hawaii County Council voted to commit Bill 326 ' relating to a new University District, to the Planning Director and the Planning Commission for review and comment. On October 17, 2006, the bill was transmitted to the Planning Director. The bill states that university and college campuses should be treated distinctly from other caning districts currently identified in Chapter 25 (Zoning Code), Hawaii County Code. In addition to educational functions, university and college campuses generally include a variety and mix of other uses. Present provisions in the Zoning Code limit the ability of universities and colleges in providing a complete and conducive campus environment and sense of community. As a result of this limitation, the County Council drafted Bi11326 to establish a University District that will provide greater flexibility in establishing a mix of uses to enhance the campus environment of a university or college. Bi11326, as drafted by the County Council (Exhibit A): • Provides for the types of uses permitted within the University District. • Establishes a height limit of 45 feet, except for a height limit of 120 feet for the City of Hilo and ninety feet for areas designated High Density Urban on the General Plan Land Use Pattern Allocation Guide (LUPAG) map. • Establishes a minimum building site area requirement of 7,500 square feet. • Establishes a minimum building site average width of 60 feet. • Establishes a front or rear yard setback of 15 feet and no side yard setbacks, except for certain exceptions. r • States that plan approval is required for all new structures and additions to existing structures. RECOMMENDATION The Planning Director has reviewed Bi11326 and agrees that a new University District is wazranted.
