Re: Resolution to Amend Resolution No. 23-07, Authorizing the Mayor to enter into an agreement
with the State of Hawaii Department of Agriculture for the Coqui Frog Eradication & Control
Program.
On January 19, 2007, the County Council adopted Resolution No. 23-07 that authorized the Mayor to
enter into an agreement with the State of Hawaii Department of Agriculture for the Coqui Frog Eradication
& Control Program. The Department of Agriculture had proposed to enter into a contract with the County
of Hawaii and provide the county with $140,000, a portion of their Act 160 funding, and for it to be used to
purchase citric acid anhydrous for the control of the Coqui frog on the Island of Hawaii.
Since then, at the request of the State Attorney General's Office, the final report summarizing the project
services completed and the final fiscal report summarizing expenditures included on the project is now
due by May 1, 2007, instead of March 1, 2007 as was noted specifically in the resolution.
Enclosed is a resolution amending Resolution No. 23-07 by changing the date of the final report
requirements from March 1, 2007 to May 1, 2007.
In order to expedite the implementation of this contract and since the only change to the resolution is the
reporting date, the Office of Management would like to request a waiver from the Finance Committee and
have this resolution heard at the next Council meeting scheduled for February 22, 2007.

A. REQUEST:
Prepare a resolution to amend Resolution 23-07 which authorized the Mayor of the County of Hawaii to
execute a Contract for Goods and Services with the State of Hawaii, Hawaii Department of Agriculture, to
enable the County of Hawaii to use these funds for the purchase of citric acid anhydrous for the control of
the coqui frog on the Island of Hawaii.
Per the request of the State Attorney General's Office, the end date of this project's reporting requirements
have been changed from March 1, 2007 to May 1, 2007. (Resolution 23-07 and its contract exhibit had
noted March 1st as the end date.)
We are requesting a waiver from the February 21st Finance Committee since the only change to the
previous resolution and contract agreement is the completion date.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The State of Hawaii Legislature enacted Act 160, Supplemental Appropriations Act of 2006.
The Department of Agriculture proposed to enter into a contract with the County of Hawaii using these funds
appropriated to them for coqui frog control and eradication under Act 160.
The County of Hawaii shall now submit to the State, a final report summarizing the project services
completed and a final fiscal report summarizing expenditures included on the project by May 1, 2007 (not
March 1, 2007).

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
