Transmitted with this letter is the 2006 Annual Report from the Public Access, Open Space
and Natural Resources Preservation Commission. The Commission has once again done an
outstanding job of reviewing various pazcels of land and developing a prioritized listing of
lands and/or property entitlements for acquisition.
The Commission's seven top priorities are listed on pages 1 through 4 of Attachment 2 to the
Report. The full comprehensive property list is shown in Attachment 4. For compazison
purposes, the first listing prepared by the Commission as of Apri15, 2006, is included as
Attachment 5. It is noted that many priority properties included on the earlier list remain on
this year-end listing, including the two parcels that were identified by the County Council as
its two top priorities for acquisition in Resolution 544-06 dated November 29, 2006. These
are Kawa`a/Kawa`a Bay and the Waipi`o Lookout Point parcel.
Recommendation
It is recommended that during 2007, the County continue to focus exclusively on the
acquisition o£
• The four parcels of land that together comprise the Kawa`a/Kawa`a Bay property,
and
• The Waipi'o Lookout parcel.
The reason for this recommendation is that the administration, at the Council's direction, has
begun negotiations to acquire these highest priority lands, and if fully carried out, we estimate
these acquisitions will require all of the funds available now and expected to be available
through December 2007, when the next listing will be received from the Commission. F~O

Kawa`a/Kawa`a Bay
The stated goal is to acquire for the people of this County as many of the four pazcels of land
that comprise this property as is possible, given the available resources and the cooperation of
the present owners.
The Finance Department was approached by the owners of one of the four pazcels of land
with a proposal to sell the land to the County. An independent appraisal was commissioned,
and an offer to purchase the property at the appraised value ($1,920,000 for 234.29 acres) was
made subject to certain conditions. This offer was rejected, so the Finance Depaztment will
begin negotiating the conditions to determine if an agreement can be reached. It is understood
by all parties that the County cannot pay more than the appraised value for any land it
acquires.
The County has also recently heazd that the owner of the other three parcels is willing to
discuss selling at least one of them to the County. The Finance Department is following up on
this and will be contracting for the necessary appraisal work so negotiations can begin.
Waipi`o
An appraisal of the parcel of land located at the Waipi`o Lookout established the fair market
value at $900,000. An offer to purchase this property for the appraised value, subject to
certain conditions, has been made. The present owners have requested an extension of time
until Apri124, 2007 to consider the County's offer, and the requested extension has been
granted.
Conclusion
I would be totally remiss if I did not take this opportunity to recognize and thank the County's
new Property Manager, Harry Yada, for his work in negotiating these potential acquisitions as
well as his work on many other land management issues. We were fortunate enough to
"steal" him from the State Department of Land and Natural Resources. He brings to the
County a valuable and extensive background in real estate and land management. We are
very fortunate to have him working for the people of the County of Hawaii.

The Public Access, Open Space and Natural Resources Preservation Commission
has been in existence for a little more than a yeaz. During this time, a prioritized list of
qualifying lands worthy of preservation was prepazed and submitted for your comments
and recommendations. The commissioners note that there has been much public interest
in the work of the commission and the process of land acquisition by the Counry. The
members of the Public Access, Open Space and Natural Resources Preservation
Commission want to say "thank you" to you, your stag and the County Council members
for initiating acquisition of some of the recommended properties.
Pursuant to Section 2-217(2) of the Hawaii County Code, requires the Hawaii
County Public Access, Open Space and Natural Resources Preservation Commission to
update the prioritized list at least annually by December 31 of each year. The attached
report contains the updated prioritized list and also describes the revised process that was
used to update the list-

Introduction
Pursuant to Section 2-2I7 of the Hawaii County Code, 1983 (2005 Edition), (see
a Attachment 1), the Hawaii County Public Access, Open Space, and Natural Resources
Preservation Commission is submitting this 2006 Annual Report and the Prioritized List-Land
and/or Property Entitlements for Acquisition (December 27, 2006) (hereinafter refen ed to as the
O "Prioritized List") to the Mayor. (See Attachment 2). The Prioritized List is an island-wide
listing based on public input and the Commission's evaluation of the merits and urgency for
acquisition of the vazious properties submitted.
Since the submittal of the Commission's initial report and prioritized list (dated April 5,
2006), several properties from this list have been strongly considered by the County for
acquisition through the Public Access, Open Space, and Natural Resources Preservation Fund.
LJ Consequently, resolutions from the County Council were adopted that authorized the
Administration to enter into negotiations for the acquisition of pazcels at the Waipi`o Lookout
Point (Resolution No. 427-06), Kawa`a (Resolution No. 451-06) and Punalu`u Beach Pazk and
Adjacent Lands (Resolution No. 452-06). In addition, a resolution was passed pertaining to the
preservation of numerous historic and cultural sites located on the Puapua`a parcel (Resolution
No. 404-06). Likewise, the Mayor, Administration, and County personnel have been working
diligently in accomplishing the potential acquisition of the afore-mentioned properties as
a previously identified by the Commission.

Commission Meetings
Since the submittal of the initial report in April 2006, the Commission conducted
monthly meetings alternating between Hilo and Kona and received additional suggestion forms
D and testimony from the public. Also during these meetings, the Commission engaged in
discussions with the Mayor, Planning Director, Finance Director, Department of Pazks &
a Recreation Director, Corporation Counsel, and other County personnel pertinent to its functions
and duties. The Commission also invited Beryl Blaich, Vice-Chair of Kauai County's Public
Access, Open Space, and Natural Resources Preservation Commission, and Dave Caylor, Kauai
Planning Department Planner, to shaze their experiences and progress with the similaz
Commission on their island. In addition, other guest presenters included Dr. Brian Szuster
(re: Hawaii Coastal & Estuarine Conservation Plan), Josh Stanbro (re: Trust for Public Lands),
and Debbie Hecht (re: Save our Lands Citizen Committee & 2% Initiative). The following list
outlines the meetings that were scheduled:

Revision of Assessment Criteria Form
The assessment criteria form used in the initial report was streamlined and revised to
reflect criteria that could be adequately assessed by Commission members with the information
at hand. As a result, Criteria 5 & 6, were deleted from this form because it was felt that this type
of information was generally not available unless further reseazch or a due diligence report was
completed for each property. In addition, Criteria 2 was revised so that the scoring would be
more balanced and would correlate with the five designated purposes of the fund. Otherwise,
Criteria 1, 3, and 4 remained relatively the same with just a few changes in the wording. This
revised 2007 Assessment Criteria Form (see Attachment 3) was used in updating the Prioritized
List for this 2006 Annual Report and will also be utilized in 2007.
Revision of Suggestion Form
The suggestion form was also revised to include additional questions and requests for
Q supplementary information and documentation relating to the suggested site or project. Based
upon the recent review of the process used by Commission members in compiling the initial
prioritized list, it was felt that there was often insufficient information to make adequate
assessments. In addition, the suggestion form format was also revised so that it would conelate
with the revised assessment criteria form. This revised suggestion form will be utilized in 2007.
For purposes of this 2006 Annual Report, the former 2006 suggestion forms were used.

Updating Prioritized List
a In updating the Prioritized List. for this 2006 Annual Report, the Commission assessed the
suggestion forms received between February 11, 2006 and September 5, 2006. There were a
a total of 12 suggestion forms that were received during this time period. The Commission
assessed these properties utilizing the revised 2007 Assessment Criteria Form (see Attachment
3). In addition, the top twelve properties from the previously submitted "Properties and/or
Entitlements for Purchase List" (April 5, 2006) were reexamined and reassessed with this revised
2007 Assessment Criteria Form.
a The properties that had a criteria score of 80% or higher were included in this year's
evaluation process for the Prioritized List.
a The Comprehensive List (December 27, 2006), which includes all of the aforementioned
properties that were assessed with the revised 2007 Assessment Criteria Form is included as
Attachment 4. In addition, the previously submitted Comprehensive List (Apri15, 2006) is
included as Attachment 5.
Next Steps
a The Commission has developed a timeline for 2007 to accomplish the following tasks:
a • Implement publicity strategy for soliciting suggestion forms for 2007
• Schedule next round of regional public meetings
• Consider site visits as a part of the Commission's process
• Explore other funding sources for land entitlement acquisitions
• Identify potential partnerships with other government agencies, non-profit
organizations, and/or private entities for land/entitlement acquisitions

a § 2-217 HAWAII COUNTY CODE
Section 2-217. Duties and responsibilities of the commission.
The duties and responsibilities of this commission are:
a (1) To develop and submit to the mayor, an initial island-wide prioritized list of qualifying lands
worthy of preservation within six months of being confirmed to the commission by the council.
Priorities shall be listed on an island-wide rather than district basis. The list shall include the
significance of each parcel or entitlement identified, the reason for its priority, and its anticipated
use after acquisition;
(2) To update this list at any time, but at least annually by December 31 of each year; and
(3) To explore methods of funding land acquisition and make recommendations to the mayor.
a (4) The commission shall give emphasis to land acquisitions where the County's contribution can be
leveraged to obtain State, Federal, and/or private funds.

Section 2-21g. Prioritized list of qualifying lands worthy of preservation.
(a) The prioritized list developed by the commission shall be submitted to the mayor for comments and
a recommendation. Within sixty days after receipt, the mayor will submit the list to the council with
comments and recommendations. The council shall, by resolution, select the land or lands to be
preserved. Under no circumstances shall the purchase price paid for a property exceed the appraised
value as prepared by an independent appraiser engaged by the County. Where there are multiple lands
under consideration at any one time, priority shall be given to coastal lands and lands where matching
funding is available to leverage the County contribution.
(b) Negotiations for acquisition of lands to be preserved shall occur between the County and the seller or its
a commissioned agent, or a licensed broker only. The commission shall have no role in the negotiations
other than in its advisory capacity.
(c) Appraisals, title reports, surveying and other costs incidental to the acquisition of land shall be permitted
a uses of this fund. These costs shall be allocated equally between the seller and the buyer.
(d) Adequate staff to carry out the provisions of this article and to manage the land acquired shall be
provided in the department of finance to maximize the use of available funds by minimizing the payment
of commission to outside agents to put together funding plans and to ensure that the County is a good
a steward of any land that comes under its control through this article.

a Article 43. Budget Stabilization Fund.
Section 2-219. Creation otfund.
Pursuant to section 10-12, Hawaii County Charter 2000, a special fund to be krtown as the budget
stabilization fund is created for the purpose of meeting general fund revenue shortfalls and to minimize the
need for budget cuts or tax increases. The budget stabilization fund shall be a temporary supplemental source
O of funds for the County to use during times of financial hardships while a plan for cost reduction or revenue
enhancement is developed.

Section Z-220. Funding.
Each fiscal yeaz following the creation of the budget stabilization fund, moneys shall be transferred to this
fund as recommended by the mayor and approved by the council.
