Your Committee on Finance, to which was referred Bill No. 19, reports as follows:
Bill 19 transmitted by Brenda Ford, Council Member, via Communication No. 63, dated January 2,
2007, to amend Chapter 2, Article 42, Hawaii County Code 1983 (2005 Edition, as amended) relating
to the Public Access, Open Space and Natural Resources Preservation Fund is amended to read as
follows:
"(5) Two percent [2~] of the Hawaii County real property tax revenues collected annually
(including penalties). The deposit of these revenues into the fund shall occur twice each year in
coordination with the collection of real propertv tax payments. The first deposit into the fund shall
occur on March 7, 2007, and shall be calculated based on all real propertv tax revenues (including
penalties and interest) collected between November 8, 2006 and February 28, 2007. The second
deposit into the fund shall occur on September 7, 2007, and shall be calculated based on all real
property tax revenues (includine penalties and interest) collected between March 1, 2007 and
Aueust 31, 2007. The deposit schedule shall continue with deposits beine calculated based on real
propertv tax revenues (includine penalties and interest) collected in the six-month periods preceding
March ls` and September 15` of each veaz and shall be deposited on
March 7`s and September 7`h of each year, respectively. All dates may be adjusted to the next
following day of business should said dates fall on a weekend or holiday. In addition, the Treasurer
shall invest all monies deposited into the fund in a conservative interest-beazing account or accounts
that allow monies to be available for propertv acquisition and prevent any erosion of the fund's
principal amount."
Bill No. 19, Draft 2, transmitted by Director of Finance William Takaba, via Communication No. 63.1,
dated January 11, 2007, to amend Chapter 2, Article 42, Section 2-214, (b), (5), Hawaii County Code
1983, relating to the Public Access, Open Space, and Natural Resources Preservation Fund is amended
to read as follows:
"(5) Two percent [2°6] of Hawaii County real property tax revenues collected annually (including
penalties). The deposit of these revenues into the fund shall occur twice each year in coordination with
the collection of real propertv tax payments, commencin on Julv 1, 2007."

Your Committee expressed concerns as to when the effective date of accruement for the 2% open
space fund should begin. Mr. Lincoln Ashida, Corporation Counsel, clarified to Your Committee
regarding the process of a bill when it is approved. Upon approval it is then signed by the Mayor.
Mr. Ashida clarifies that an effective date is at the bottom left hand corner of the bill. Mr. Ashida
further states that the Mayor with good faith effort is willing to go back from when it was voted on by
the people of the County.
Your Committee on Finance is in accord with the purpose and intent of Bill No. 19 as amended with
Draft 2, and recommends it pass first reading.
