Pursuant to Section 3 of Ordinance No. 96-51, we are resubmitting the
attached resolution for your consideration.
To assist you in your decision making and to address questions which were
previously raised regarding this project, we are also attaching the
following information:
• Tables which summarize the existing and projected connections
and flow rates and the percent compliance based on the various
sewer projects
• A letter from Linda Reeves, Audits Resolution Coordinator for
EPA, warning the County of possible ramifications should the
County fail to fully utilize the plant
In discussions held with both the State Department of Health and Linda
Reeves of EPA, Ms. Reeves stated that by completing the Kaapoko Extension
as proposed, the County would be showing a good faith effort to meet
compliance requirements and that she would consider the audit closed.
However, should the County fail to utilize the available Federal monies
and construct the extension, this matter could very well be turned over
to the U.S. Attorney for enforcement action. Therefore, we recommend
that the Council seriously reconsider the resolution and the possible
financial impacts it could place on the County.
The Council should also be aware that an expeditious review is critical
as the Farmers Home Administration is requesting that the County move to
finalize and close out the Pap aikou Phase II project. Should this occur,
the County will lose the over $500,000 in federal monies and will not be
able to do any additional sewer extensions under this project.

Under separate cover, we are transmitting the proposed resolution to the
Public Works Committee Chair for introduction. Also, because this
resolution has previously been discussed at great length, we request that
you waive the committee meeting and agendize the resolution for the next
full Council meeting. Your favorable consideration of this request would
be greatly appreciated. We will be available at the Council meeting to
answe any dditional concerns you may have.

Subject: Mandatory Sewer Construction Projects
Dear Mr. Yagong:
This letter is in reply to your inquiry of last week regarding the EPA-mandated sewer
construction projects in the Papaikou wastewater treatment plant sewer service area.
On March 23, 1993, EPA issued a Final Determination Letter (FDL) which states that
$6,891,902 to construct the Papaikou wastewater treatment plant will be eligible for EPA grant
funding once the plant is fully utilized. To fully utilize the wastewater treatment plant, the FDL
noted that the County must construct sewers to connect at least 75% of the homes and structures
in Papaikou and Paukaa to the sewer system, and the treatment plant must receive at least 75% of
the design capacity after a reasonable and necessary adjustment due to unrealized population
growth in the area.
Based on information provided by the County of Hawaii, the FDL noted that construction
of the Papaikou Phase II and Paukaa Phase II sewers would fully utilize the treatment plant.
However, the County of Hawaii recently informed EPA that construction of these sewer projects
will sewer fewer homes than indicated in the FDL, and may not result in full utilization of the
Papaikou wastewater treatment plant. Should the County fail to achieve full utilization of the
Panaiknu wastewater tre~tm?nt plant EPA will reconsider the eligibility of the $6,891,902 'o
construct the plant. We urge the County to construct all sewer projects necessary to fully utilize
the treatment plant.
