Re: Capital Budget
At the County Council Meeting held on February 7, 2007, the Council approved Bill 11
which appropriated $250,000 for the construction of a new comfort station at
Kamehameha Park. However, when construction bids were publicly opened on February
22nd, the apparent low bid was at $419,200. And, in order to award the construction
contract to execute this project, an increased appropriation is needed. Initially, funding for
this project was to come from the fair share assessment contributions from the Kohala
Ranch LLC in conjunction with Condition M of Ordinance 92-40 for the Kohala Ranch
Project IV. To make up the necessary amount ,the fair share assessment contribution
will now total $380,000, up from the original $250,000, and the County will have to put in
the remaining $40,000.
Enclosed is a bill for an ordinance amending the Capital Budget by appropriating an
additional $170,000 to the Kamehameha Park Comfort Station project, thus increasing this
fiscal year's funding from $250,000 to $420,000.
In accordance with State procurement rules, the County has 60 days following bid opening
in which to issue a letter of award to the apparent low bidder. Failure to issue said award
letter results in invalidation of the bid or allows the contractor to negotiate for inflation in
costs arising from the delay. In order to issue the award letter, sufficient funding must
already be in place and all negotiations with the contractor completed. To enable the
County to meet this 60 day deadline, the Department of Parks and Recreation respectfully
request for waiver from the Finance Committee and to have this bill heard at the Council
Meeting scheduled for March 21, 2007.

A. REQUEST:
To amend Ordinance 06-80 as amended, the Capital Improvement Projects budget, to increase the curcent
Fair Share appropriation for Kamehameha Park Comfort Station (110.599.5594.58.115) by $130,000, from
$250,000 to $380,000. Additionally, we request to amend Ordinance 06-80 as amended, the Capital
Improvements Projects budget, to create a new appropriation for Kamehameha Park Comfort Station in the
amount of $40,000 to receive County-funding (as opposed to Fair Share funds) to cover the balance of the
bid amount.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
On February 7, 2007, Bill 11 was approved which appropriated $250,000 for the construction of a new
comfort station at Kamehameha Park to be funded by Fair Share contributions. On February 22, 2007,
construction bids were publicly opened upon which the apparent responsible low bid was determined to be
$419,200 and thus in excess of the estimated project cost. In order to award the construction contract to
execute this project, and given the differing, available funding sources with which to do so (additional Fair
Share funds augmented by County funding), both the increased and new appropriations requested are
necessary.
We respectfully request consideration to waive initial presentation to Finance Committee and, instead, place
directly on the agenda of the full Council. Construction bids were opened on February 22, 2007 and are
valid for acceptance by the County for not more than 60 consecutive calendar days. Waiving Finance
Committee, and assuming this recieves favorable consideration at both readings of the full Council, will allow
just enough time to complete execution of the contract within the allotted time period and secure the current
price for the much needed project. The area of the park this comfort station will be located at, near the main
ball Feld, tennis courts and children's playground, is currently being served by portable toilets rented by the
department

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
