Your Committee on Planning, to which was referred Bill No. 25, reports as follows:
Bill No. 25, transmitted via Communication No. 86 from Mayor Harry Kim, dated January 8,
2007, presents a Change of Zone request from Agriculture 3-acre (A-3a) to Residential and
Agricultural .5-acre (RA-.5) by Glenn T. Nakamura, at Waiakea, South Hilo, Hawaii, TMK:
Z-Z-56:23.
Bill No. ZS seeks to amend Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code 1983 (2005 Edition), by changing the District
Classification from Agricultural-3 Acres (A-3 a) to Residential and Agricultural-.5 Acre (RA-.Sa)
at Waiakea, South Hilo, Hawaii.
Communication No. 86 reports that the Hawaii County Planning Commission, as required by
Chapter 4, Sec. 6-4.3(C), Hawaii County Charter, considered the above request on December 1,
2006. The Commission concurred with the Planning Director's reasons for recommending
favorable consideration of the change of zone. Communication No. 86 transmits the following
findings and recommendations:
1. The subject property is located on the west side of Awa Street, approximately 400 feet
north of the Mamaki Street-Awa Street intersection, Panaewa House Lots 2" Series,
Waiakea, South Hilo, Hawaii.
2. Applicant is requesting a Change of Zone from Agricultural 3-acre (A-3 a) to Residential
and Agricultural .5-acre (RA-.Sa) for approximately 2.649 acres of land to subdivide the
subject property into three residential and agricultural lots of approximately 38,000
square feet in size. The proposed request will allow applicant and his two sisters who
inherited the property from their parents, to create three separate parcels which will then
be conveyed to family members. Applicants are also requesting a concurrent State Land
Use Boundary Amendment (Bill 24) from the Agricultural District to the Urban District.
3. There is an existing 40-year old single-family dwelling situated on the front portion of the
property and the remaining portion is vacant. The subject property is one of twenty-five
(25) lots approved under Subdivision No. 2083 (Panaewa Farm Lots 2"" Series) on

February 19, 1964. The cost of the proposed subdivision is estimated to be
approximately $50,000.00.
4. Access to the site is from Awa Street, a County road with a 50-foot wide right-of--way
with a 20-foot wide pavement and 6-foot wide grass shoulders.
5. County water is available to the property. The two additional parcels will utilize
individual wastewater systems meeting the approval of the Department of Health.
6. The Planning Director recommended favorably on this request based on the following:
• The proposed change of zone request from A-3a to RA-.Sa conforms to, among
others, the goals, policies and standards of the General Plan Economic and Land Use
Elements.
• The request is not contrary to Chapter 205A, Hawaii Revised Statutes, relating to
Coastal Zone Management Area as the property is not situated within the Special
Management Area. The property is located approximately 4.5 miles from the neazest
coastline and therefore, will not be impacted by coastal hazard and beach erosion.
• The Land Use Pattern Allocation Guide (LUPAG) Map designates this area as Low
Density Urban, which designation includes residential, ancillary community and
public uses, neighborhood and convenience-type commercial uses.
• Surrounding properties are zoned A-3a and include a mix ofsingle-family dwellings,
agriculture uses and vacant land. Panaewa Farm Lots 1~` Series (approved under
Subdivision No. 1041 on February 11, 1957), is located adjacent to and immediately
north of the subject site. This area was reclassified into the Urban District during the
1969 Boundary Review.
• The U.S. Corps ofEngineers Flood Insurance Rate Map (FIRM) designates the
property as Zone "X", areas determined to be outside the 500-year flood plain. The
property is unclassified by the Agricultural Lands of Importance to the State of
Hawai` i (ALISH) System and the Land Study Bureau. While the potential for
agricultural use may exist, the soil conditions within the property and surrounding
area preclude conducting such agricultural activities.
• Because the property is developed, it is not anticipated that endangered or threatened
candidate species of flora or fauna are located within the subject property, nor has the
area been identified as a significant botanical or biological habitat. Presently, there is
no evidence of any traditional and customary native Hawaiian rights being practiced
on the site, nor existence of known valued cultural, historical or native resources in
the area. Therefore, it is anticipated that the proposed request will not have any
adverse impact upon cultural or historical resources in the area.

• Requisite of the Planning Director's favorable recommendation for the change of
zone request, are fourteen (14) conditions contained in Bill No. 25 which outline
specific requirements for the proposed project.
At the February 21, 2007 Planning Committee meeting, no statements were received from the
public.
Council Member Bob Jacobson noted that the uses as per the LUPAG Map were appropriate
does not impact the area at all.
Your Committee concurs with the Planning Commission and the Planning Director's favorable
recommendation for approval of the Change of Zone request.
Your Committee on Planning is in accord with the purpose and intent of Bill No. ZS and
recommends it pass first reading.
