SUBJECT: BILL 156 ,DRAFT 2 (2004-2006)
AFFORDABLE HOUSING REQUIREMENTS
FOR INDUSTRIAL PARKS DEVELOPMENTS
At the March 9, 2007 council meeting, some councilmembers expressed a desire to
modify this bill so that there was a greater incentive for the developer of an industrial
subdivision to satisfy the affordable housing requirement, rather than pass it on to the
eventual lot purchasers. This could be done by changing to last sentence in Section 2 of
Bill 156 to read as follows, with additions to the current last sentence of Draft 2
underlined and deletions bracketed:
"The applicant may also satisfy the affordable housing requirement at the
time of final subdivision approval for all or a portion of the lots created
within the rezoned area, provided that in that case, the applicant shall be
required to earn one affordable housing credit for every [eight] ten full-time
equivalent jobs created, based on ten full-time equivalent jobs per acre."
This language does two things. First, it allows the developer of an industrial subdivision
to satisfy the affordable housing fox a portion of the subdivision, in other words, for
selected lots. At the time of subdivision, the developer does not know whether the uses
in the industrial subdivision will trigger affordable housing. For example, if a lot is used

for a restaurant, it will not trigger affordable housing. So the developer does not want to
satisfy affordable housing for all the lots at the time of subdivision. Allowing the
developer to satisfy for some lots means that the developer can market those lots to
purchasers who otherwise would have to provide affordable housing.
Second, it reduces the requirement to one housing credit per ten employees, versus one to
four employees if the affordable housing requirement is satisfied later. This is an
additional incentive to satisfy affordable housing requirements at the time of subdivision.
Administratively, it is simpler if the affordable requirements are satisfied at the time of
subdivision approval rather than as businesses move into the individual lots.
