COUNTY OF HAWAII STATE OF HAWAII
RESOLUTION NO. 133 U'7
RESOLUTION ACCEPTING THE DONATION OF PARKING AND RESTROOM
FACILITIES AT WAI`AHA 1ST, DISTRICT OF NORTH KONA, COUNTY AND
STATE OF HAWAII, FROM SUNSTONE REALTY PARTNERS X LLC.
WHEREAS, the County of Hawaii is the owner of Tax Map
Key: (3)7-5-018:088, the site of the Wai`aha sewage pump station; and
WHEREAS, pursuant to Condition E(5) of Ordinance 03-18, Sunstone Realty
Partners X LLC was required to provide public parking stalls and restroom facilities
along the mauka side of Ali`i Drive on the County's Wai`aha sewage pump station site to
accommodate the public's use of Wai`aha Bay; and
WHEREAS, final site review was done and received the Department of Parks and
Recreation's approval; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides
that the Counci] may accept gifts of donations of money, securities or other personal
property or of real estate or any interest in real estate.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii
County Charter, and Ordinance No. 03-18, that the County of Hawaii accepts the
parking stalls and restroom facilities along the mauka side of Ali`i Drive on the County's
Wai`aha sewage pump station site to accommodate the public's use of Wai`aha Bay.
BE IT FURTHER RESOLVED that a letter of appreciation be sent to Curtis D.
DeWeese, Sunstone Realty Partners X LLC, 1250 Pauahi Tower, 1001 Bishop Street,
Honolulu, Hawaii 96813.
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to:
(1) Mayor Harry Kim; (2) Patricia G. Engelhard, Director, Department of Parks and
Recreation; (3) Harry M. Yada, Property Manager, Department of Finance; (4) Assistant
Corporation Counsel Gerald Takase; and (5) Steven S.C. Lim, Carlsmith Ball, P.O.
Box 686, Hilo, Hawaii 96721-0686.
