Subject: Transmitting Bill 156, Draft 4
The attached draft 4 of bill 156 incorporates the amendments made to this bill during the
Council's meeting of Apri14, 2007. These amendments were transmitted to the Council
by Planning Director Christopher Yuen, in communication no. 200.13.
Please note that this attached draft 4 contains two non-substantive formatting errors that we
respectfully ask the Council to correct during their next hearing of this bill.
First, the title of the section, "Section 11-4. Affordable housing requirements" should
be removed from the text of the amendment. It is not a part of subsection (d) that is the
subject of this amendment. With this text removed, SECTION 2 of the bill would read:
SECTION 2. Chapter 11, article 1, section 11-4(d), Hawai'i County
Code 1983 (2005 edition), relating to affordable housing requirements for
industrial uses, is amended to read as follows:
"(d) Requirements for industrial uses...."

Second, in paragraph (d)(2)(B), the "(B)" that precedes the text should be underlined, as it
is being added to the language of the Code. As amended (with the "(B)" underlined) the
affected text would read:
Rezonings to ML, MG, or MCX, aooroved after (the effective date of
this ordinance)...."
