I would like to commend Hawaii County Councils efforts in attempting to make your
community more flood resistant by proposing stricter ordinance language in Chapter 27,
of your County Code, that exceeds the minimum standazds of the National Flood
Insurance Program (NFIP). Your County's interest in the Community Rating System
(CRS) will only help to enhance your program and provide for a safer community.
As a participating community in the National Flood Insurance Program (NFIP), Hawaii
County is required to adopt and enforce floodplain management regulations that meet the
minimum NFIP requirements as set forth in Title 44 of the Code of Federal Regulations
§59 through 79. In return, Federally-backed flood insurance is made available in your
community.
Unfortunately, the language in your current code does not adequately meet the minimum
standards of the NFIP. Since last April, I have worked with your Public Works
Department to ensure that the necessary provisions aze incorporated into a revised
Chapter 27. (An electronic copy of my comments was forwarded to your office on March
28, 2D07 for your information. )
It is important to understand that if a community's floodplain management ordinance
fails to meet the minimum requirements of the NFIP, they are subject to suspension from
the program, in accordance with Title 44 of the Code of Federal Regulations (§59.24).

Ii is evident that Hawaii County Council is taking a proactive approach to safe floodplain
development in your community and that maintaining eligibility in the NFIP is of utmost
concern. With that, I am confident that we can work together to bring Chapter 27 of your
County Code in compliance with the minimum NFIP regulations. Please feel free to
