Re: Proposed amendments to Resolution 169-07
I am writing to inform you of my intention to propose the following amendments to Resolution
169-07, to be discussed on May 1, 2007, in the Finance Committee meeting:
• Reference to the ordinance number has been deleted and reference to the Chapter and
Article in the County Code has been added to the title as follows:
A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO ENTER
INTO NEGOTIATIONS FOR THE ACQUISITION OF PUNALU`U BEACH
PARK, NINOLE POND AND ADJACENT LANDS IN THE DISTRICT OF KA`U,
PURSUANT TO HAPTER 2. ARTICLE 42. HAWAII
COUNTY CODE.
• Due to the redundancy of referencing the ordinance number and the chapter and
article of the county Code references to the ordinance number has been deleted from
the first and second "WHEREAS" clauses to read as follows:

Code, established the Public Access, Open Space, and Natural Resources Preservation
Commission; and
WHEREAS, n a• ^T . nc °G, a•F • section 2-214, Hawaii County Code,
established the Public Access, Open Space, and Natural Resources Preservation Fund;

• Due to the existence of an updated Public Access, Open Space and Natural Resources
Preservation Commission report a sixth "Whereas" clause has been added to reflect
the newest ranking of Punalu`u Beach Park, Ninole Pond and adjacent lands to read
as follows:
WHEREAS the Public Access Open Space and Natural Resources Preservation
Commission did forwazd its updated list to the Mayor on December 27, 2006, establishing
the purchase of Punalu`u Beach Pazk, Ninole Pond and adjacent lands as the number four
priority and assig_nina it an 84% criteria score: and
• The word "initial" was added to the forth "WHEREAS" clause to read as follows:
WHEREAS, the Public Access, Open Space, and Natural Resources Preservation
Commission did forwazd its initial list to the Mayor on Apri15, 2006, establishing the
purchase of Punalu`u Beach Pazk and adjacent lands, as the number three priority, and
assigning it a 70% criteria score; and
