Condition "L" Parks and Recreation Plan
Dear Mr. Yuen:
Condition L of the change of zone ordinance identified above states:
(L) to ensure the Goals and Policies of the Recreation Element of the General Plan are implemented,
the applicant shall
formulate a recreational plan to address the impacts of the project for review
and approval by the Planning Department, in consultation with tke Department of Parks and
Recreation prior to submitting plans for subdivision of any portion of the subject property. The
recreational plan shalt be consistent with Chapter 8 Article 1, Park Dedication Codes The
implementation of the Recreational Plan shall be completed in conjunction with each phase of
development of the subject property;
We have had discussions with you regarding the applicant providing additional acreage adjacent to the
higher density Ouli Ekahi project for a manager's unit next to the County's affordable rental project which
could include a hard surface play court for use by residents of the affordable rentals and self-help housing
project in the area. Your letter dated May 5, 2004, accepted this proposal to comply with this condition.
Your letter dated February 21, 2007 reminded us of our agreement and our commitment to prepare a
formal recreation plan in consultation with the Department of Parks and Recreation and Office of Housing
and Community Development (OHCD).
I arranged a meeting on March 5, 2007, with Norman Hayashi of your office, James Komata, planner with
Parks and Recreation and Ed Taira, administrator of OHCD. We discussed the ordinance condition and
the agreement that we have regarding the provision of acreage for a managers unit for the Ouli Rental
Project and the paved basketball court adjacent to this land. As a result of that meeting I am
memorializing this agreement into the Parks and Recreation Plan required by condition "L".

PARKS AND RECREATION PLAN
The applicant, Hale Wailani Partners, will subdivide out and dedicate the land adjacent to the County's
Ouli Rental Project on the subject property to the County of Hawaii to be used for a manager's unit and
basketball play court. The proposed parcel is 24,800 square feet or 0.57 acres as shown on the attached
exhibit, prepared by KN Consulting Services, the applicant's engineer.
The applicant agrees to grub the entire parcel, grade the play court area, and pave the basketball play
court area (80' x 100') with asphalt, install a basketball backboard and rim at each end and fence the
perimeter of the play court area with chain link fence at a height of six feet. These improvements will be
completed prior to receiving any Certificate of Occupancy for any units in the first phase of the
development.
It is our understanding that the play court will be open to the general public with posted hours of
operation and managed and maintained by the Office of Housing and Community Development. There
will be no lights for night time play.
This donation will satisfy Condition "L" of Change of Zone Ordinance No. 94 (REZ 759)
