This is to acknowledge receipt of your letter dated April 11, 2007 requesting information
regarding time conditions for Change of Zone Ordinance No. 02-131 and Special
Management Area (SMA) Use Permit No. 430.
We agree with your letter regarding time conditions and acknowledge there are no other
time constraints than those acknowledged by your letter, but add that Condition No. 3 of
SMA 430 requires the applicant to notify the Kuakini Makai Association, Inc. within
thirty (30) days prior to commencement of construction.

On behalf of Kona Vistas, IBC, we are requesting confirmation of deadlines for fulfilling Honolulu
conditions of zoning and SMA approvals for the above-described property. Kona Vistas Guam
acquired the property from Gamrex, [nc. in 2006 and is taking over the responsibility of Hong Knnq
Philippines
fulfilling the various requirements for the project. On January 15, 2007, the company filed the seat(le
most recent annual progress report per Condition 7 of SMA Use Permit No. 430, which was Singapore
subsequently accepted and forwarded to the County Planning Commission. The property's 7haila"°
zoning ordinance has no annual progress report requirement.
Although Kona Vistas prepared the latest report, it is still bringing itself up to speed on
all the requirements for the project. The company is most concerned that it meets the various
deadlines as specified in the zoning and SMA conditions. In particular, Kona Vistas would like
to know if there are any due dates that are not specifically stated or apparent in the conditions
that the Planning Department is cognizant or knowledgeable of for this project.
Conditions A to G of Zoning Ordinance 02-131 relate to general requirements, specific
tasks, and essentially the single-family zoned portion of the property. The owner has fulfilled
and/or acknowledges these conditions. For Conditions H and I that relate to the multi-family
zoned portion of the property, Kona Vistas is cognizant of the deadline to secure final plan
approval for the first increment of that development by November 27, 2007. Condition J,
which relates to the potential Unified Impact Fees Ordinance, will be addressed when/should
that ordinance be adopted.

For Condition K, which relates to the provision of housing opportunities, the owner has
an agreement with the County Office of Housing and Community Development (OHCD) to
convey 12 acres of land for affordable housing when construction of the project's drainage
system is completed.
We believe Conditions L and M have been satisfied, Condition N will be addressed in
the multi-family plan to be submitted under Condition H, Conditions O and P have been
addressed, and Condition Q is being fulfilled with the soon-to-be submitted drainage plan for
the multi-family site (no specific deadline is stated for that condition). The single-family
residential portion of the project already has received drainage plan approval.
Conditions R and S, relating to archaeological surveys and stop work procedures, have
conditional submittal dates but no specific deadlines. The owner has satisfied Condition T and
acknowledges Condition U.
For the SMA Use Permit, it appears that only Conditions 2 and 7 have specific
deadlines. We acknowledge that construction of the drainage improvements is to be completed
by May 5, 2008 and that the project's progress reports are to be submitted annually. The other
conditions relate to general requirements, tasks to be performed with no specific deadlines,
construction methodology, and public notification.
As mentioned above, we are requesting the Planning Department to confirm whether
there are any other deadlines for the project per Zoning Ordinance 02-131 and SMA Use
Permit No. 430.
