Change of Zone Application (REZ 06-000054)
Applicant: Big Island Ventures, LLC
Subject: Sidewalks in Naalehu
TMK: 9-5-24:8
On February 2, 2007, the Planning Commission voted to forward a favorable recommendation to
the County Council for the above-referenced change of zone from a Single Family Residential -
7,500 square foot (RS-7.5) to a Village Commercial-7,500 square foot (CV) district. The
Commission concurred with the Planning Director's findings and reasons for a favorable action
on the request.
Currently with the Council for review, the proposed conditions of approval do not include the
construction of a sidewalk fronting the praperty. Because the conditions of the zoning limit
development to the existing dwelling, the Director did not recommend curb, gutter and sidewalk
improvements. These would not connect with any other sidewalks and would have limited
usefulness. In addition, as explained below, it is also to be consistent with previous rezonings in
the area.
A change of zone from RS-7.5 to CV-7.5 for TMK: 9-5-24: 76 (adjacent property to the east),
was approved by the County Council by (Ordinance No. 90 131 (REZ 673) effective October 20,
1990. Similarly, a change of zone from RS-7.5 to CV-7.5 for TMK: 9-5-24: 77 was approved by
the County Council by Ordinance No. 90 129 (REZ 672) effective October 20, 1990. In 1991,
the applicants requested the deletion of Condition D in both ordinances (provide curb, gutters, ! L~ Q

sidewalk improvements) because "there are no sidewalk improvements anywhere along the
mauka side of the Mamahahoa Highway in Naalehu" and the construction of a sidewalk would
affect the existing drainage system. The County Counci] voted to delete Condition D. Ordinance
No. 90 131 was superseded by Ordinance No. 92 14 effective February 18, 1992; Ordinance No.
90 129 was superseded by Ordinance No. 92 15 effective February 18, 1992.
Ordinance Nos. 92-14 and 92-15 are not actually in effect because the time conditions were not
satisfied.
