SUBJECT: "AMENDMENT" to our "Violation of Section 25-2-30, Hawaii
County Code and Ordinance No. 97-54, Amending Section 25-8-2
(North and South Kona District Zone Map), Article 8, Chapter 25
(Zoning Code), Hawaii County Code (ZCV 06-113" Letter dated
April 16, 2007
Tax Map Kev: 7-3-024: 012, Portion Kaloko-Mauka Subdivision,
Kaloko, North Kona, Hawaii
It has come to our attention that our previous letter dated April 16, 2007 requires
"amending" based on further investigation and discussions with several parties.
1. The 4,602 square foot dwelling permitted under building permit
B2004-1619K was not constructed.
2. A letter dated October 7, 2004, was submitted to the Building Division,
requested that Building permit B2004-1619K be transferred to Randy
Davis, and to void this permit. Building Permit B2004-1619K was not
"voided."
3. It has been confirmed by the Building Inspector of the area that the
structure described under B2004-1619K has not been constructed on the
subject property, and the building pennit will be "voided" per the letter
submitted on October 7, 2004.

4. The Building Inspector of the area has further confirmed that structures
under building permits B2004-1620K and B2004-1761K have been built.
Further, the conversion of the Garage structure under B2004-1761K to a
dwelling is currently being completed under Building Permit B2007-
0216K.
Based on the above, this letter "AMENDS" our previous letter dated April 16, 2007,
Subject: Violation of Section 2s-2-30, Hawaii County Code and Ordinance No. 97-
54.....(ZCV 06-113W), in parts.
1. Page 6 is "Amended to DELETE" subparagraph "11" in its entirety.
2. Page 7 is "Amended to DELETE" Corrective Action No. 2, and "RE-
NUMBER" Corrective Action No. " 3)" to read: " 2)."
3. Page 7, last paragraph, is "Amended to READ, in part:"
"If you do not complete Corrective Action No. 1 by May 17, 2007, a fine
of $100 per day will be assessed until the corrective action is completed.
