RE: Submitting Proposed Amendment to Bill No. 80, Draft 2, regarding Mass Transit
Attached please find a proposed amendment to Bill 8Q, Draft 2. This amendment corrects a misspelling
in the text of the amendment. It also replaces SECTIONS 4 - 6, which were inadvertently placed in the
bill, with SECTIONS 2 - 4, that contain the language adopted by the Public Works and
Intergoverrunental Relations Committee during its meeting on May 1, 2007. The following ramseyered
text shows the differences between this nrovosed draft and the existing Draft 2.
"SECTION 1. Chapter 2, Article 14, Hawaii County Code 1983 (2005 Edition) is
amended to add a new section to be appropriately numbered and to read as follows:
Section 2_ Authority to adopt rules and regulations
The agency is ~a~e] authorized to adopt reasonable rules and
regulations as the agency deems necessary for the administration of the
conduct of the agency's business, including rules and regulations for fees
and charges for permits for interior advertisements on buses. Rules shall
be promulgated pursuant to Chapter 91, Hawaii Revised Statutes, as
amended.

SECTION 2 If anv provision of this ordinance or the application thereof to anv
person or circumstance is held invalid such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application and to this end the provisions of this ordinance are declared to be
severable.
SECTION 3 Material to be repealed is bracketed and stricken. New material is
underscored In printing this ordinance the brackets bracketed and stricken material
and underscoring need not be included.
SECTION 4 This ordinance shall take effect upon its approval."
A copy of the bill that incorporates the proposed amendment is attached. This attachment shows the
differences between the amendment proposed in this bill and the language in the existine County Code.

AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 14 OF THE HAWAII COUNTY
CODE 1983 (2005 EDITION) AS AMENDED, BY ADDING A NEW SECTION RELATING
TO AUTHORITY OF THE MASS TRANSIT AGENCY.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 2, Article 14, Hawaii County Code 1983 (2005 Edition) is
amended to add a new section to be appropriately numbered and to read as follows:
"Section 2- Authority to adopt rules and regulations
