RE: Floor Amendment to Bill No. 80, regazding proposed changes to Section 1. Chapter 2, Article
14, Hawaii County Code 1983 (2005 Edition), for the Public Works Committee meeting on May 1,
2007

I will be submitting the attached floor amendment during the Public Works Committee meeting on
May 1, 2007. It appears that the word "interior" was inadvertently omitted from Bill 80, although it was
cited in the letter of transmittal from Thomas Brown, Transit Administrator.
2- Authority to adopt rules and reeulations
The agency is authorize to adopt reasonable rules and reQUlations as the a¢ency deems
necessary for the administration of the conduct of the aQency's business, includine rules
and reeulations for fees and chazves for permits for~WlarioT advertisements on buses.
Rules shall be promuleated pursuant to Chapter 91 Hawai' i Revised Statutes, as
amended.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 14 OF THE HAWAII COUNTY CODE
1983 (2005 EDITION) AS AMENDED, BY ADDING A NEW SECTION RELATING TO
AUTHORITY OF THE MASS TRANSIT AGENCY.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 2, Article 14, Hawaii County Code 1983 (2005 Edition) is amended to add
anew section to be appropriately numbered and to read as follows:
2- Authority to adopt rules and regulations
The aeencv is authorize to adopt reasonable rules and regulations as the aeency deems
necessary for the administration of the conduct of the agency's business, including rules
and regulations for fees and charges for permits for interior advertisements on buses.
Rules shall be promulvated pursuant to Chanter 91 Hawaii Revised Statutes, as
amended.
SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored.
In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be
included.
SECTION 5. If any provision of this ordinance or the application thereof to any person or
circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the
ordinance which can be given effect without the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its approval.
