RE: Transmitting a Draft 2 of Resolution 102-07,
"A Resolution Amending Resolution No. 55-07, Adopting Rules of Procedure and
Organization of the Council of the County of Hawai`i."
Transmitted is a draft 2 of Resolution 102-07, relating to the Council rules. This drafr
incorporates changes to rule 16 (formerly rule 17), of the Council rules. This rule relates
to "reconsideration" and was adopted by the Council during its April 18, 2007 meeting.
Council Member Stacy Higa proposed these changes in communication no. 242.1. The
changes to Resolution 102-07, Draft 1, that were adopted by the Council and
incorporated into Draft 2, have been ramseyered, and include the following:

motion has been made and carried in the affirmative or negative, anv Council
Member voting with the maiority may move for a reconsideration of the vote on the
motion at the same meeting or at the next regular meeting. However, anv Council
member who wishes to ask for a motion to reconsider at the next meeting must
notify the Council Chairperson and County Clerk in writing of their intention
to make such a motion within five (5) working days after the bill passes final
reading A motion to reconsider the vote taken at the time anv bill or resolution fails
Mass final reading shall not be voted upon until twenty-four (24) hours have
elapsed."
Comment: During its April 18, 2007 meeting, the Council agreed to add the term
"working" before the term "days. " This term ("working') is bolded and underlined
to aid the reader. a

taken only following notice as required by law."

remain in the possession of the Council and the Clerk shall not transmit, file, or
otherwise dispose of it until the time has expired for Council members to notify the
Council Chairperson and County Clerk in writing of their intention to make a motion
to reconsider at the next meetine, unless it is deemed filed pursuant to ordinance or
the time for its passage has expired by operation of law. If the motion to reconsider
fails, the vote previously taken on the bill or resolution shall become final, and the
Clerk shall so note in the journal."
