P December 22, 1997 To: James Arakaki, Chairman and Members of the Hawaii County Council From: Al Smith, Secretary-Treasurer Hawaii State Association of Counties (HSAC) Subject: HSAC Executive Committee Meeting -December 10, 1997 The following highlights of the HSAC Executive Committee meeting of December 10, 1997 are hereby submitted. The Secretary's Minutes of the Executive Committee Meeting of November 14, 1997 were approved and placed on file (attached for information). The Treasurer's report for October 1997 was approved and placed on file (attached for information). Under NACo/WIR Reports, President Mansho advised that Hawaii will have a booth at the NACo Legislative Conference where counties will be able to promote their islands as pre or post conference destinations for the W1R Conference in Juneau and the Annual Conference in Portland. Under Unfinished Business, the Executive Committee deferred action on the HSAC Legislative Policy Statement, the HSAC Legislative Package, and on a National Policy on Alcohol and Substance Abuse Testing. Amendments dividing the duties of the HSAC Secretary-Treasurer were approved by all counties. Under New Business, the Executive Committee reviewed a NACo Statement of Values which were adopted by the NACo Board of Directors and the NACo General Membership on July 15, 1997. It is proposed that HSAC also adopt this Statement of Values (attached, Action Requested). The next meeting of the HSAC Executive Committee is scheduled for 10:00 a.m. on January 20, 1998 at the Honolulu City Council Committee Room. EXECUTIVE COMMITTEE MEETING MINUTES The minutes of the September 26, 1997 meeting of the HSAC Executive Committee were approved as circulated. III. TREASURER'S REPORT The Treasurer's Report for the month of September 1997 was corrected for a typographical error on page 2 and was approved as circulated. 1V. REPORTS A. Executive Committee Reports There were no Executive Committee Reports. B. County Report The following county reports were approved and placed on file: 1. From Ron Kouchi, HSAC Second Vice President, to President Mansho, dated September 25, 1997, regarding the approval of Resolution No. 49-97 and Resolution No. 50-97 2. From Daryl Yamamoto, Maui County Clerk, to President Mansho, dated October 6, 1997, transmitting a copy of Committee Report No. 97-206. 3. From Daryl Yamamoto, Maui County Clerk, to President Mansho, dated October 20, 1997, transmitting a copy of Committee Report No. 97-215. 4. From C. Bunji Shimomura, Kauai County Clerk, to John Desoto, Chair, 1-lonolulu City Council, dated September 29, 1997, regarding the adoption of Resolution No. 49-97. 5. From C. Bunji Shimomura, Kauai County Clerk to President Mansho, dated September 12, 1997, regarding the approval of proposed interim amendments to the HSAC Bylaws and Policies, dividing the duties of the Secretary-Treasurer. C. NACo Report The next NACo Board Meeting is scheduled for December 4-7, 1997 in Minneapolis, MN. Vice President Nakamura is planning to attend. D. WIR Report Secretary-Treasurer Smith submitted a written travel report on his trip to Santa Fe, NM for the WIR Fall Board. His report was placed on file. V. UNFINISHED BUSINESS A. HSAC Legislative Package The Executive Committee reviewed proposals for the 1998 HSAC Legislative Package as submitted by Maui County. (See memorandum from Dennis Y. Nakamura, HSAC First 2 Vice President to President Mansho, dated October 7, 1997; and communication from David Raatz, Maui OCS, to Andrew Sekine, Honolulu OCS, dated November 6, 1997). These proposals were referred to the counties for consideration. B. HSAC Legislative Policy Statement The purpose of this item is to act on a draft of the 1998 HSAC Legislative Program Policy Statement. See communication from President Mansho to Executive Committee members, dated August 26, 1997. The Counties of Kauai and Hawaii have both adopted the proposed 1998 HSAC Policy Statement. The Honolulu City Council will be discussing this matter on 11/21/97. Maui County, on the other hand, has amended the Policy Statement. The Executive Committee reviewed the proposed amendments as submitted by Maui County and concurred with the intent of its provision 9 and accordingly agreed to limit HSAC officers or designees to testifying only on proposals which are in the HSAC Legislative Package. As to provision l0 relating to informal polling, because of conflicts with the provisions of the Honolulu Charter and of potential conflicts with our "Sunshine" Law, the Executive Committee could not support this particular provision. The remainder of the provisions related to procedures for ensuring efficient communications with respect to legislative matters affecting the counties. It was noted by the Executive Committee that each of the counties already have their respective procedures for notification and the sharing of information. Recognizing Maui's proposed amendments, and the fact that the City Council had once been a proponent of limiting what HSAC officers or designees could testify on, the Executive Committee revised the 1998 HSAC Legislative Program Policy Statement to read as follows: "1998 HSAC LEGISLATIVE PROGRAM POLICY STATEMENT The Hawaii State Association of Counties (HSAC) shall be guided by the following policies during the 1998 legislative session: 1. The Executive Committee shall determine the strategy for HSAC's efforts during the Legislature. 2. An HSAC officer or designee shall testify before the Legislature on proposals in the 1998 HSAC Legislative Package." President Mansho will notify Maui County that after a review of Maui's proposed Communications Policy Statement, the Executive Committee has drafted a revised 1998 HSAC Legislative Program Policy Statement for consideration by the association. 3 C. United States Air Rights Negotiations The purpose of this item is to act on HSAC's proposal to support Honolulu Council Resolution 97-126, CDI, urging the United States Department of Transportation to recognize Hawaii's geographic constraints during air rights negotiations. This matter is still pending on Maui County. President Mansho will communicate with the Council and Committee Leadership on Maui and offer assistance in resolving areas of concern. D. County Authority to Designate Enterprise Zones The purpose of this item is to act on HSAC's proposal to support Honolulu Council Resolution 97-212, urging the Hawaii State Government to comply with Section 209E-4 of the Hawaii Revised Statutes, which authorizes the counties to designate enterprise zones. All four counties reported support of Honolulu Council Resolution 97-2 ] 2. Hawaii County on 9/3/97, Kauai County on 9/24/97, Maui County on 10/3/97, and the City and County on 7/19/97. E. Statewide Uniform Alcohol and Substance Abuse Testing Policy The purpose of this item is to act on a resolution urging the Governor and the four counties of the State to collectively establish a statewide uniform alcohol and substance abuse testing policy. See Honolulu Council Resolution 97-255. This matter is still pending on Maui County. President Mansho will communicate with the Council and Committee Leadership on Maui and offer assistance in resolving areas of concern. F. National Policy on Alcohol and Substance Abuse Testing Program The purpose of this item is to act on a resolution urging the President of the United States and the members of the U.S. Congress to establish a nationwide uniform alcohol and substance abuse testing policy. See Honolulu Council Resolution 97-314. This matter was referred to all four counties for consideration. G. Proposed ]nterim Amendments Dividing Duties Of Secretary-Treasurer The purpose of this item is to act on the proposed interim bylaws and policy amendments to divide the duties of the HSAC Secretary-Treasurer. See Honolulu Council Resolution 97-272. 4 c , This matter is still pending on Maui County. President Mansho will communicate with the Council and Committee Leadership on Maui and offer assistance in resolving areas of concern. Vl. NEW BUSINESS A. HSAC Mid-Year Conference, December 10-12, 1997 A request for an $1,000 advance for the planning of the HSAC Mid-Year Conference from President Mansho to HSAC Executive Committee dated November 5, 1997 was approved by the Executive Committee.. B. Privatization The purpose of this item is to act on a resolution requesting the Governor and the State Legislature to give priority attention to addressing and resolving matters relating to privatization. See Honolulu Council Resolution 97-339. This resolution complements Maui's privatization proposal for the 1998 HSAC Legislative Package. C. HSAC End-of--Year Conference It was reported that the 1998 HSAC Year-End Conference will be on Kauai. Maui will be hosting the 1998 HSAC Mid-Year Conference. Dates will be announced later. VII. COMMUNICATIONS The following communications were placed on file: A. From President Mansho to NACo President Randy Johnson, dated October 6, 1997, regarding the NACo annual dues increase. B. From President Mansho to William Hachmeister, dated October 6, 1997, regarding an avionic/aerospace proposal. Vlll. ANNOUNCEMENTS HSAC Mid-Year Conference to be held December 10-12 at the Turtle Bay Hilton Flotel on Oahu. The next HSAC Executive Committee is scheduled for 9:30 a.m., Wednesday, December 10, 1997 at the Turtle Bay Hilton. The HSAC General Membership Meeting will follow at 10:30 a.m. 5 IX. WHEREAS, the National Association of Counties (NACo) has adopted a statement of values to guide NACo's efforts in helping counties define and secure their own community vision; and WHEREAS, it is proposed that the Hawaii State Association of Counties (HSAC) adopt the above-mentioned statement of values; and WHEREAS, the statement of values recognizes that economic opportunity, environmental integrity, and societal equity are the foundation upon which counties can build a better quality of life for their citizens; and WHEREAS, the statement of values further recognizes that as locally elected representatives, county officials have a significant responsibility to provide leadership in seeking community based solutions that strengthen their own counties; and WHEREAS, the Council concurs with the sentiments expressed in the attached statement of values; and WHEREAS, the unanimous approval of all county councils is necessary for HSAC to adopt the statement of values; now, therefore, BE IT RESOLVED by the Council of the City and County of Honolulu that this body approves the attached statement of values; and BE IT FURTHER RESOLVED that the Hawaii State Association of Counties adopt the statement of values upon unanimous approval of all county councils; and OCSOl000.R97 RESOLUTION BE IT FINALLY RESOLVED that the Clerk is directed to transmit copies of this Resolution to the President of the Hawaii State Association of Counties.
