Chapter 27, Flood Control.
Dear Council Chair Hoffmann:
Public Works Director Bruce McClure asked us for initial opinions regarding
some potential legal issues arising from the revisions to Bill No. 51, Draft 2, regazding
amendments to Hawaii County Code, Chapter 27, Flood Control. We understand that
these issues aze also relevant to the cun•ent Draft 3.
Mr. McClure asked that we forward to you, under attorney-client privileged
cover, copies of the May 21, 2007 initial opinion letter which we provided him, for your
information as you consider the currently proposed amendments to Bill No. 51, Draft 3.
Please find said copies enclosed. Since Director McClure and the County Council share
a common legal interest in ensuring that revisions to Chapter 27 aze legal, these matters
maybe considered attorney-client privileged unless all parties agree otherwise.
The enclosed letter is of a general, issue-spotting nature. We will be glad to
further discuss these matters with the Council and Mr. McClure as you may request.
