Your Committee on Public Safety and Parks and Recreation, to which was referred
Resolution No. 133-07, reports as follows:
Resolution No. 133-07, transmitted by Assistant Corporation Counsel Gerald Takase via
Communication No. 292, dated Mazch 21, 2007, accepts the donation of parking stalls and
restroom facilities at Wai`aha 1st, North Kona, County and State of Hawaii, from Sunstone
Realty Partners X, LLC.
Pursuant to Condition E(5) of Ordinance No. 03-18, Sunstone Realty Partners X, LLC was required
to provide public pazking stalls and restroom facilities along the mauka side of Ali`i Drive on the
County's Wai`aha sewage pump station site to accommodate the public's use of Wai`aha Bay.
Mr. Duane Erway testified in support of the resolution via videoconferencing from Kailua-Kona.
Pursuant to Article XIII, Section 13-12, Hawaii County Charter, the Council may accept gifts of
donations of money, securities or other personal property or of real estate or any interest in real
estate.
Your Committee on Public Safety and Pazks and Recreation is in accord with the purpose and
intent of Resolution No. 133-07 and recommends its adoption.
